Yes, but whether they are using them in the game is not the question... they are claiming the copyright. THAT is the issue. If the people who made the items don't fight it now, they will lose the copyright. Sometimes art is borrowed for inhouse demos to show proof of concept (mostly, do the mechanics work), and artists aren't hired until the game is spec'd and ready for production... however, art put out publicly by a company needs to be original or have licenses and permissions.
