Remember that the Poser figure's CR2 file does not generally contain the model geometry. Therefore you can create a unique character based on an existing Poser figure and distribute the CR2 file. You would not need to distribute the copywriten Poser geometry file. As mentioned above there are exceptions regarding some figures, but generally this should answer your question.
