But I recall a case where someone tried to sue Lego over their Bionicle line because it infringed on Polynesian mythologies and cultural heritage. http://archives.cnn.com/2001/WORLD/asiapcf/auspac/06/01/newzealand.maori/ so yes, it is possible for someone to sue over the use of a character from mythology or any other aspect of cultural heritage. Perhaps not under US laws, but we all know that US law isn't the only one we have to worry about these days.
