Yes but those business can only do so because the laws (and the courts) have provided exception to the general rules, due to health and sanitation reasons. As with a theater who can tell you not to stand up and yell fire in the middle of the movie when there is no fire.

Thats completely different though, in my own humble and worthless opinion, than the situation that some feel is ocurring here. Today.

Then again I also think some of the "consternation" if you will thats gone on is due simply to the fact that most people are resistant to change to begin with.

But I on the other hand do also feel that one should be able to discuss pretty much whatever it is they want too, without having to fear being "warned" or "banned" provided they are'nt doing or saying things that break the law, like threatening someone's life, or the president etc.....

I don't know about everyone else but I can tell you that there are times when I have had some thoughts on some matters brought up here, and even some suggestions for making the "community" better, and don't say anything at all around here, purely because of the threat of getting "warned" or "banned".
P.S. I also wanted to say that while I know it is a hard job to mod or admin a site, personally my biggest "whine" if you will, is that there does appear to be, to me at least, no such thing as fair or equitable application and enforcement of the TOS. And thats because I have seen people get some of their images taken down, (wizard something or other was their name) yet I discovered darned nearly pornographic kiddy one's wich were left up and ok. That gives the appearance me, (who is, I realize, on the "outside" looking "in") that basically mods and admins just enforce the TOS whenever the feel like it, irregardless of wether someone's actually violating it or not. And I hope that this discussion won't get be banned, or deleted to the ethers of sub space. LOL
