"that decision is subjective???" Worse than that usually: arbitrary. Why bother having a clear policy when it's more fun to make it up as you go along? That way, decisions depend on what mood you're in. If it's a Monday morning and you're in a crappy mood, the TOS can mean whatever you want it to mean, and people you don't like can suddenly find themselves outside the rules. I also wonder whether it would be a different decision depending on the nude being male or female. My bet is that something relatively tame (say, along the lines of Mapplethorpe's 'Man in a Nylon Suit') would be gotten rid of, whilst the blood-spattered uber-titty brigade march on to conquer the galleries unhindered.
