Well, there is the crux of the matter. As I said above, yes they can protest if they discover the likeness. Just because something is not specifically a crime does not mean you can't get yourself into legal difficulties. I would not be at all happy to have my digital likeness used without my permission and I would make as much trouble as I could for the person responsible.
