The first question would be "Does my site being hosted in L.A mean the laws of the US and California apply to the conduct of the business" The second question would be "Does the fact that I do not charge for hosting the product and payment is made direct to the seller isolate me for any damages resulting from Copyright or trademark infringment, defective product or any other failures on the part of the merchant" Somewhere in there would be a "Because I live in Romania does this mean I am unlikely to be successfully prosecuted because of ......" I think you need to consider some sort of fee because you probably have some bandwidth limits on the host site and if it becomes popular it could get expensive. Charging a fee though probably exposes you to some liability. You would need to collect and report sales tax for anything sold in California if your website is considered a place of business.
