As long as you could get her out of the SPCA. Deal with them; if he pulls this stunt again, at least they can cut him off at the source.

You might check with the laws in your area, there's web sites full of stupid laws. Some places have leash laws (for a cat?), and there may be clauses in your lease about pets; most places do (at least that I've lived in), so if you get the law and the landlord on your side, you'll be better off..
