I think if you buy something and you download it, hey it's yours.  Using the site as a back up isn't very smart, but I know when my external crashed, I went back and downloaded everything again from the site (this was a few years back, so I don't know how easy it is now and my husband hasn't purchased anything yet from this account).

In the case of permanent bans, I think those members should still be allowed to use the store, just not be able to upload images (another idea that was presented to the site and was flatly denied by Peter).
