Personally, I don't see that reselling the programs or whatever is illegal. After all, you bought the cd, it is yours, and then you can, if you want, sell it. I would say that as long as the disk is the original, then nothing can be done about it. I could be wrong, but I'm pretty sure that this is the case. Sure, he may have another copy of his own that he made, but he can't sell those, and basically this can only be a one time thing for him. I've seen old software at yard sales, flea-markets, you name it. Selling it on ebay is no different.
