Unfortunately, if the burglar got hurt in the break-in, he can sue for medical, etc.
There was a judgement recently for a burglar who robbed a house while the people were on vacation. He left through the garage door and it locked behind him. The garage door opener didn't work so he couldn't get out (that should have been easy to figure out). He spent a week in the garage drinking a case of pepsi. He sued and won a huge settlement.
I think that's crap. If you put yourself in harms way on purpose, you should not benefit from it. The same as not being able to write a book about your crimes and making money from it.
