The way I see this particular case is like those art sale ads you see on TV where they flash a bunch of nice oil paintings on the screen, and without any credits at all.  The goal of those ads is to bring the public to the gallery, and nothing else.  Imagine if all those painters decided to sue the gallery and the TV stations....  If this society gets any more legally complex, everything may get shut  down.
