if it's an american software, it's likely that most of the coding was outsourced to mumbai or shanghai, and that the only american involvement is product management. hence one should give credit where credit is due. I ain't a lawyer, but as I understand it, opinions about software, however negative, are not considered libellous, as long as it's plain to the average jury that it's just an opinion, and not a deliberate misrepresentation.
