The TOS makes sense to me. The Market place is as the word says, a place of marketing so naturally the vendors have to display their products, within the confines of the MP TOS. The gallery is a place to show what you have created. It has a TOS that has to be followed, not really a strict as it could be. Personally I have no problem browsing the galleries or the market place. Each serves a different purpose.
