Subject: The Bryster gets his revenge!!!!

Well it seems I gotta clear up a few points.
In the local justice system we have a Magistrates Court run by......you guessed it.....Magistrates - 3 Guys/Gals who decide between them who's guilty etc. This is the court that deals with guys getting drunk and a bit naughty, shoplifters, minor drug offenses, traffic violations like speeding and parking offences and such.

Go up one level and we get Crown Court. This is more serious and we get to meet Judges who deal with serious robbery, firearms & knife offences, the odd murder...............etc.

Then we get the High Court and quite literally the Big Wigs (Yup Quest! They still wear wigs).....highpowered Judges for cases like mass murder, treason, big fraud cases, using apps other than Bryce.......

So back to the case in hand,

He is 19 and what we call a 'boy-racer'. A kid with a new driving license who drives a small but powerful car recklessly  and hopes he doesn't actually kill someone but if he does, hopes he doesn't get caught.

Now the car was his. He was insured. And he worked for his dad. He wasn't legally drunk. But he had been out on a binge for the entire weekend.
He slammed into me while I was at a standstill at 50mph, putting me and my son in hospital.

nruddock is right.  This was the case that dealt with the criminal offense of 'driving without due care & attention'.  I had no part in this case other than that I was permitted to observe the proceedings along with my son and our wives. However, the court was informed of our presence and therefore understood that we (the victims) were taking the matter very seriously in deed. This generally helps the case for the prosecution because if we didn't turn up everyone would think that we couldn't care less.

The next phase is the bit where we sue him through his insurance company. In other words, my insurance sues his insurance at no cost to me. The only question is 'how much are they willing to fork out for my trauma, injuries damages ect.

The fact that he has been tried as a criminal adds to the weight of my case against him.
However, from the moment he hit my car it was out of my hands. Being a Motability driver the police have to step in.  From then on he was on a hiding to nothing. 

Why am I so vengeful?
Chohole said it for me. I am disabled. So being hit from behind at 50mph by a kid who didn't even hit the brakes doesn't do my health any good. My son was also injured and is still having problems. Also that day, my grandson was offered an afternoon out with his dad and grandpa riding in grandpa's new car. Well someone on high was looking out for him 'cos he said that he's rather stay at home with mom. He's never ever done that before.

My son and I ended up in the hospital, myself having to be backboarded out of my car by the fire and ambulance guys (I love you long-time).....you do the math.

And yeh...the kid tried to tell Daddy that I was rolling back down the hill - I was driving up the hill - in an car with an automatic gear box, but was stationary at the time of impact -, and, that he didn't see me on a clear day in perfect driving conditions.

This was his second crash in a year. If I didn't do my best to get him off the road he would have killed someone - probably still will if he passes another driving test.

He ruined my life for the last 4 months and I'm still trying to put the whole sequence of events into perspective. 

I really appreciate you guys and all your thoughts. I'm always amazed at the support this forum gives to each other. Thanks. You're all worth your weight in gold.

On a lighter note, I kept asking myself 'what did I do wrong?' a bit like the only guy who survives an airplane crash asking why was he the only one?

Then I remembered asking the cop who took my statement at the hospital the same question.
He said, " You got out of bed this morning..."
