In that case the image should either be in a gallery or at the very least clearly labelled as an artists work. Including the image as part of the commercial Daz installer suggests to me that it is a commercial product. I've noticed that Daz also use other artist's work in banners on their site, but with no mention of what the characters are, so yes, I do think it is daft to show the characters with no indication of how anyone might acquire - at the very least - the base models for thier own work. In that sense it is surely not good business.
For example, what would be the point of a newbiie desiring to illustrate an anime character scene and thinking that all they needed was V4.2 , when they might be better advised to purchase the A3 figure. And I mention A3 because there's something suspiciously anime about the eyes on the above picture which makes me think it might be A3 instead of V4.
I see your point, however, that particular view has never bothered me. I'm used to advertising just about everywhere showing products "Larger then life", or companies using high end outstanding results for advertising, rather then your average run of the mill user results.
If I shose to look at it the way you do, I'd be extremely pissed about Zbrush or MAX and similar software, because I can't create things with it that high enders whose work they use to advertise their software can do.
I agree, it is frustrating, but, I don't see it as 'their fault'. It's just frustrating wanting something I can't get, or have, or make or buy.
