I'm not sure just a name is copyrightable.  IMO you'd need a complete package before you can talk about copyrights.  In fact I just looked at the us copyright office and names cannot be copyrighted.  Some can be trademarked though.

Now if you can distinguish your version of your superhero with the same name, you might have grounds to say your creation is unique and therefore is original and can be trademarked by you.  In fact, there are about 30 different "superman" trademarks at the USPTO.  This one is by a canadian firm that is not DC.
