If you distribute the image you may be liable for civil damages from one (or more) of the invasion of privacy torts ((1) Intrusion, (2) Appropriation, (3) Private Facts, or (4) False light. E.g. the tort of appropriation is the commercial use of a persn's name, image or likenes withut permission (Restatement 2nd of Torts para 652a-652i) Best advice is consult your attorney before you proceed.
