ok, I'm going to give this one more try and attempt to be concise.
scenario: you are looking through the freestuff. You like the new feature. You think it's cool. you see that alot of stuff is labled "no-commercial". great! but this presents a problem.
memberA. you are a newbie here and you take the "no commercial" at face value and respect it and decide not to download the item.
memberB. you know this is a new feature of the downloads, so you download the item and open the zip, and see it was mis-labled. or you see it was labled correctly and respect the submitter's wishes. (we hope).
Both A. and B. are not informed regardless of the new feature. in fact, they are possibly mis-informed.
What is the Flaw in the feature as set up? It assumes that the download will be refreshed by the submitter. This can have a negative effect for two reasons, the submitter doesn't care or isn't around much anymore. Or the submitter just refuses to edit and leaves them be. Who does this hurt? It hurts memberA and memberB who don't have a clue about the whys or ways of the Freestuff. The lesson here is that regardless of the feature, nothing has changed for the user except that now stuff is possibly mislabled.
How to fix it? simple. Make the default "not specified". This takes care of all the problems.
Ok, now a related point. I looked at the "what's new". I assume the majority of these new and re-edited items are "fixed" by the submitters. If that is true and if the first 8 or so pages are an indication, then.... The Majority of the submissions are "for commercial use". So logicaly the default seems to be in error. By the by, If you use "RSR converter" for your market items. According to the "freestuff" designation, you are breaking the law and the submitter's agreement.
I know the staff didn't do this to mis-lead or to hurt anyone and perhaps thought it was a good suprise they were giving us. THe problem is they didn't think it out and they don't seem to be willing to fix it :(
Did I open this can of worms? No. I just found it.
