Hi,
I see a texture set which has my stuff in it, and which violates one of my freestuff Terms Of Use.
I have contacted the creator of said package, but creator stated yesterday there had not been a response from the store admin yet.
PP and 3DC pulled this the second they were made aware of this, and there is no issue between me and the creator of said package on this, we've solved this in a friendly manner between ourselves.
Apparently the store admin asked for a better explanation, and it seems the set's creator's word wasn't enough because the set is still there.
So - how do we get to see any admin action on this ?

Hi Sprinter, You need to file a formal complaint. The link to do that is in the copyright forum. Once a formal complaint is filed, the copyright agent will investigate. Deb

Actually, the nick is spinner, dear, I am sure you are capable of differentiating between nicks, yes ? Ok, so basically - you are telling me that despite a merchant telling you via email to pull a product so said merchant can update it due to a copyright violation, no harm done, you're actually also demanding a formal complaint be made, depsite the fact this was solved in a friendly manner between the parties ? This merchant has contacted you thrice over email. Surely you are able to assist a merchant who's repeatedly contacted you over pulling a set ? On the other hand - if it's that easy to get all confused over a little nick, I can well understand I have to complicate matters and formalise this. ~s

I do apologize for my mistake with the nick. I was reading too many things at one time. But basically yes, all copyright complaints need to be filed formally via the online complaint form. Basically because we get tons of "I think this looks like my texture", and we'd spend all our time looking into "nothing". Formal complaints are handled by the Copyright Agent. Deb

Ok. Let me take this very.slowly. * A merchant with a product in the store has tried to contact you. * Thrice. * Said merchant cannot get a hold of you so said merchant can update said set. * Maybe, and just maybe, it would be an idea to read your email, and help said merchant with uploading an update of the set. * This would probably save a lot of people work of looking into what you so eloquently put as "nothing" I hope this was clear enough. Forgot to also mention that products that aren't in the MarketPlace for at least 30 days cannot be pulled unless there are technical issues with the product, OR a valid copyright concern whereas a complaint is filed. Hope that helps, Deb

If this is the same merchant I'm thinking of, I'm still waiting on a reply from them based on the fact that I cannot pull a product unless it's for one of the reasons I've mentioned to them, and in my previous reply to you. Excuse me, Rendo won't let a merchant pull or update a product unless there is a copyright complaint or a technical issue?? Even though the matter has been settled between infringer and infringee ? That bang you heard - that was my jaw hitting the desk when it dropped open. As for slow - you are very welcome. I can see Renderosity takes it's toll on many an intellectual capacity. Last question - could you please explain the reasons behind the 30 day/no update policy ? ~s

Let me explain this *VERY* slowly to you so maybe you can understand *wink*There was never a mention that we couldn't update a product within 30 days, I simply stated that we couldn't pull a product within 30 days of entering the MarketPlace unless there is a technical issue (that would be resolved) OR there is a formal copyright complaint filed on the product. Those are the exceptions for pulling a product within 30 days of entering the MarketPlace. Now I'm not even certain that we're talking about the same product, because no complaint has been received from the original copyright holder.
This time I'm going to provide you with the link to the Official Copyright Complaint form in case you're having trouble locating it. If you just put your mouse over the link above and click it will bring you right there :)
Oh, and the reason for the 30 day no pull policy is because of resources and time used to test the product, we feel that 30 days is adequate enough time to give a product a fair chance in the MarketPlace. Also, new merchants are limited to 3 products until a certain amount is reached. If we were to allow merchants to pull products with no time limits, new merchants wouldn't be giving products enough time in the MarketPlace to recoup testing, etc.. costs.

I am so sorry - it seems your ability to explain seems as challenged as your capacity to comprehend, as I mentioned the phrase "update" repeatedly. No complaint has been received from me, because I solved this with the merchant in question, and all which is needed is for the merchant to update said product. Which said merchant has tried to do, and has contacted you thrice about this, and is still awaiting a response from you, this being the reason I posted. I am so very glad to see renderosity is displaying it's usual level of competence, it gives one a safe and warm fuzzy feeling that there is such a special... person such as yourself taking care of our best interests, especially since a copyright issue already has been solved, and the need to click on a link to the tuber-watch forum is not necessarry at this point. Since such amazing skill and competence has been demonstrated in comprenhending the concepts of "update" and "issue solved" and "merchant trying to contact you", I'll just take this to Clint - I know he lacks your some of your more prominent gifts, but at least I know he'll help me get something solved. Hey spinner, Just to confirm with you also, there is no mention from the "infringing" merchant on an updated file, nor is there any trace of one on the ftp server, or in the pending queue. I would be more than happy to update the zip in the MarketPlace right away if I could get an updated zip. That would save you from filling out the copyright complaint form. Thanks again! Deb

Spinner, I'm not sure what you are hoping to accomplish by the "tone" of your posts. There is really no need to put implications in your posts that she is "challenged" or "incompetent". She has been repeatedly trying to explain to you our procedures that have been in place for some time now. The merchant in question never even replied back to Debbie regarding this product. She informed you that she is waiting on a response from the merchant and until that happens or you file the complaint nothing else can be done. If you and the merchant worked it out amongst yourselves then why aren't they sending an updated zip so we can replace whats in the store? Thats all they need to do and we're just waiting on them to do what they need to. Its really very simple and I certainly see no need for all the hostility you are showing in your posts???? Spinner, Yes it did bother me because there is never a reason to treat another human being with such disrepect when they are not deserving of it and I just can't figure out why you felt the need to do that. It does bother me because I care about others and don't like to see anyone that doesn't deserve it being talked "down" to. I am done with the subject but I was certainly going to put in my 2 cents when I see something like this that is so unneccessary. You can contact Clint but the result will be the same as Debbie already explained to you what needs to happen. Stacey

Debbie's post bothered me because I do not feel the need to post a complaint on behalf of myself and the other involved party because we've already solved this issue by speaking directly with the merchant, who needed to talk to Debbie or someone else in the store to get the thing updated, and had been trying for a few days. Secondly it bothered me she did not seem to see what i was saying, and since I have little patience for someone not paying attention in class, I decided to be extra clear. If you didn't like it, too bad. ~s

And of course the whole taking 50% of the sale isn't enough here as it is in other stores so of course the item has to stay so that they can garner the top selling initial 2 week period.
Giving the product a fair chance in the marketplace is a good explanation for pulling a product - but not really for keeping one ;-)
Frankly the product should have been pulled as soon as a merchant contacted you that they had screwed up and the item was infringing on copyrights - even if the copyright holder didn't contact you - the admittance by the merchant should have been enough to pull the product and frankly if it wasn't I'm a bit appalled...

Ah. Stacy, I see... So what you're saying is, that when a potentially volatile thread is dying down, in comes a mod and puts the need to share her opinion before letting it die out ? Oh - one of the things that irked me, since we're elaborating: If you both had been paying a little attention, you'd see I had a copyright discussion going in the copyright forum already. Silvermage - this is sort of like the film Brazil. You can admit and confess to skinning and murdering for a V3 texture - but if no customers file a complaint, then it's all A-OK for at least 30 days. ~s
