Hello All,
We have amended the TOS to reflect the No Nudity policy on Avatars.
Please be sure that your avatar does not contain any nudity.
Thanks

This is a good idea, Stacey. But, what about my bald head? I'm wondering if I should put a hat on?
Miss Nancy posted Thu, 27 July 2006 at 2:00 PM
yeah, I reckon you would hafta do that. nothing worse than reading the poser forum at work and having the boss peek over one's shoulder at all the nudie pix in the avatar column  of course, they can turn off avatars in their options, but then they'd miss all the non-nudes as well.
StaceyG posted Thu, 27 July 2006 at 2:34 PM
I think we can let the bald head slide Terra:)

Thanks for this update... it's consistent with the existing TOS... helps lots when not browsing from the privacy of home. Good thing I didn't opt for the kinky version of my avatar.

That's fine with me. Elsewhere (people who knows me also knows exactely WHERE) I'm using one best described as a d*ckhead. (and no that's not a u) but I'd never dream of using it here :)
Uhm..
on second thought...
Snape on my avatar actually IS nude. Does the nudity cover male torsos as well? (and I'm honestly asking)

If anyone's avatar had nudity in it, I sure didn't notice.

ernyoka,
Yours looks fine to me. No problems with adult male torso:)

Joe,
Please contact copyrights@renderosity.com or contact JenyK by site mail for the correct answer to your question.
Thanks so muchl
TrekkieGrrrl posted Sat, 29 July 2006 at 5:48 PM
Axctually it would be very nice if that answer could be given in public.
Either you can or you can't use pictures of live people (that are not yourself or family)
So could we please have a ruling on this?
Could I, if I wanted to, use a PHOTO of Snape as my avatar?!

It's best if people do not use copyrighted work for avatars. However, "fair use" does allow for personal use, and many of us may not even recognize images that aren't your own. I would have never known that your image was Snape.
I'd let your Snape avatar stay, but if we get a copyright complaint I'll need to remove it (and hopefully you'll be understanding about it) smile
I'd rather not have to monitor avatars daily :)

It says,
"Avatars may not contain any nudity."
That's kinda vague, though, isn't it? What's the Renderosity definition of nudity?
According to dictionary.com, the definition of "nudity" is, "the state of being without clothing or covering of any kind".
So, what parts exactly need be covered and clothed?
This applies only to human depictions?
How do we know?
Like, for example, say I decide I want a 3D sphere to be my avatar... Let's assume I have failed to clothe or cover it. Therefore, I am guilty of a violation of the never-ending, expanding, vague TOS?
of course, the bigger question is, with a million or so pages full of nude digital images in the galleries, what does it matter if the avatars are nude?
I mean, if y'all are going for "respectability" in the world of CG, I could think of many other ways of going about achieving that....
Jumpstartme2 posted Fri, 04 August 2006 at 10:50 PM
 MikeJ....humans, humanoids, faeries, things of that nature...if they contain boobs, nipples, bare butts, or genitals, they need to be covered....I dont see anything 'vague' about that.
The reason nudity in avatars is not allowed is because they are not covered by the nudity flag available in the galleries.
If you would tick the image as containing nudity if you were to upload it to the galleries, then assume the same image has nudity if you are going to upload it as an avatar....in which case..you cant use it as an avatar.

Damn, what happened to you? You sound all corporate now and all. ;)
Nevertheless, strictly speaking, the TOS doesn't specifically say boobs, nipples, bare butts, and so on - just "avatars may not contain any nudity".
In strict adherence to the definition of nudity, in the lack of an official Renderosity version of said nudity, it is my contention that anything and everything not covered by clothing (and "clothing" could be a completely new definition in its own right), is now illegal.
I mean, think about it - if y'all want to be all official, serious and legal about everythfing, there need be a definition of terms.

I sound all corporate and stuff?? Ha! Nope, Im still the same 'ol Jumpy
Seriously tho..I think it all just comes down to common sense about what constitutes nudity...a 3D sphere with no texture would not be considered nude..whereas a character like V3 with no clothes on would be....c'mon now LOL

Ya know, you're seriously interfering with my hopes of irritating the PTB. ;)
Nevertheless, ol' jumpy One, the TOS, being an attempt at a legal document, need have its arguable points made non-arguable, wouldn't you think?

Yup, and thats what I attempted to do....but you 'know' in order to keep the TOS document in a professional format, we cant put "boobs, nipples, bare butts, and genitals" in there right?

Actually, considering that the site in question actively markets products and derivites of ....software which, above and beyond has , at its core, complete nudity as a default, (and encourages a gallery to help selI same), would find it irresponsible not to have its own definition of "nudity".
Of course, they didn't really need that before, but, you know, once they go and make new rules, it's time for some definitions, I'd say.
Oh, and why couldn't you put in the terms, boobs, nipples, genitals, etc ? it would seem to me that any verbiage that accomplished a refinement towards a specific definition would be a good thing.

Nudity = obscenity? Or, in the illustrious words of the U.S. Supreme Court years ago regarding 'obscenity', "I'll know it when I see it!' (Now, all we have to know is just WHO is this ''I" person? WINK). T.P.

DEBBIE M: Hello, kind soul. You wrote above, "However, "fair use" does allow for personal use,"
Question: Does this also apply to use of 'downloads' at your most wonderful site for similar 'personal' useage or only to 'avatars'?
I have had an ongoing discussion in the 'copyright' forum about such downloads relating to such use.
Thanks, in advance, for any/all help. MUCH appreciated.
My best, TallPockets.

Perhaps a better phrasing for the Avatar line would be "Avatars may not contain nude human figures."
That way, you won't have people claiming anything without clothing isn't allowed (like dragons, every dragon is technically "nude", as are most animals) and that line of the TOS isn't as arguable.

Don't let her lie to you, shes NOT the same jumps we all loved, ever since she became a moderator and went over to the dark side, she's darth-moderatus, the evil sith queen. But thats ok, if we all just keep showing her love and understanding we can still yet bring her back we can.
