Subject: Making a Comic or Animation Short using Content

So basically i was wondering what can we do with the poser content?

Are we allowed to use them in a Webcomic?
If that web comic ever gets big and becomes a movie or animation Can I still use the models? or would I have to Remake all the models again.

Of Course I do know all character personalities, and likeness and names i get to keep, because I actually created those, But the models That i use are basically actors.

What are the laws regarding this?

It says in the license that as long as i give them credit? But does that mean I have to give them a percentage if I actually do make money?

Any Ideas?

Any render still or animated using  poser/DAZ figures  can be used for commercial purposes
You Can NOT Distribute the Figure models geometry,textures etc themsevles though.

check in copyright forum for specific uses of specific items. freebies usually have a readme prohibiting commercial use, but vendors of commercial items usually allow commercial use.

Any freebies are usually not commercial, but anything I buy is mine to use commercially and I don't have to give credit although I usually do. If I can't use it for commercial renders animations I'm getting a refund. You have the right to do your movie, or comics no matter how big it gets, but like wolf said you can't distribute the models. If they want a change you will have to do it or point them in the right direction to buy the models, which I have done on one project.

You can certainly use most commercially sold content for anything you want as long as its only images or animations. You might have a problem if it gets big in protecting your characters from being used in other works by other people . You might get some advice from a copyright and trademark lawyer on that issue .

Why do you say most commercially sold content? If they have sold it they have sold the right to use it as stated in the EULA. If you know of any content sold here that you can't use commercially in renders or animations I would like to know which ones they are so I can get a refund or not buy them if I don't have them yet.

My characters such as name and likeness?

One issue that I always have trouble with is stuff that stores sell that is obviously very close to pre-exsisting copyright material.

Technically we are allowed to use what we purchase in commercial endeavors, but there are a few items that are way to close for comfort.  Daz Troll is a classic example (ie: Lord of the Rings Cave Troll).  There was a forum discussion way back about a vehicle in one of the stores that closely resembled something for one of the Alien movies.

Since I do sometimes use what I buy for commercial work, and I have published a web comic in the past and I do intend on doing more complex commercial work in the future, I try dilligently to avoid these "inspired by" items.  Unfortunately it is a "buyer beware" issue.  i have purchased a few items form these categories that I later learnt were very close to other intellectual properties.

I'm not saying things like this should be pulled out of the stores, as there is a market in fan pics and such, but I really would like these things to be earmarked in some way.  But alas, I digress.

The renderosity store requires specific rights across all products , as does Daz. I buy on occasion from other vendors for use in Lightwave and some products I have encountered do try to limit commercial use or claim a royalty for each use . I stay clear of those :)
