I came across this while searching the interwebs. Looks like even the name of my superhero is a copyright violation. I am going to start over. New name, new powers, new costume... I am even going to rework his origin...

Such is life.  There's been a huge increase in the number of hero types since the 1960s. Even stupid ones like The Flaming Carrot.  

Chances are, if you had an idea, someone else did, too.  That said, I reckon I have a concept for a hero that's never been done before.  Am I gonna mention it here?  Not on your life.  :)

I hear ya. I had a pretty active imagination going as a kid. I'll just have to dig into that old box and see what is in there.

I just plugged "quantum man" and superhero into google, then same with photon man and same with turbo man and they already exist.  It's gonna be hard for you.

Unless you get pretty creative.  Maybe dropping man, girl or woman from the name completely might help in finding somethin unique.  Also, using an alternative term which describes the same thing might help.

I think I've got the answer.  How about a name that is from his origin rather than describing a power.  eg if he comes from the planet xxxx, then he becomes xxxx man.

I'm not sure just a name is copyrightable.  IMO you'd need a complete package before you can talk about copyrights.  In fact I just looked at the us copyright office and names cannot be copyrighted.  Some can be trademarked though.

Now if you can distinguish your version of your superhero with the same name, you might have grounds to say your creation is unique and therefore is original and can be trademarked by you.  In fact, there are about 30 different "superman" trademarks at the USPTO.  This one is by a canadian firm that is not DC.

Just don't go calling your character Captain Marvel.  The history of that name and its ownership is convoluted enough.

I am thinking of going that route, utilizing his origin as a starting point. He got his powers in a factory explosion when a particle from a planet that exploded landed in the factory, then vaporized and infused itself in his DNA during the explosion.

I am toying with the idea of changing his powers too, since his arch nemesis is living fire. If they do battle it would be fighting fire with fire, so to speak.

And I was never keen on the title man or woman in a superhero I create. All the cool ones are definitely taken. Super--, Wonder--, Spider--, you get the idea...

Hmmm... he's from earth. The particle that gives him his powers is from 10,000 light years away from earth. We never know the name of the planet, as it gets vaporized when a star goes supernova...

But I am still working on it. I haven't given up all hope. I thought about giving him a name like Hancock. Not that specifically, but maybe something unhero-like...

Doh!  I can't believe "176-824" is already taken!  I guess I'll have to settle for "176-823"...but everyone knows that is no better than a sidekick.
