It depends. Look at the ReadMe file-- it may say if the file is or in not licensed for use as a base for original creations. Many are. If not, it's best to try to contact he artist and ask, and in any event to give their original fle .url and readme with the file. I'd treat it just as if I were citing someone's published article.

I would think that it would be legal, because what you are sending would consist of your work only and none of the original texture.

I think shadowcat's right. Its just not the same thing as a derivitive work.

Besides, if you put out just the difference, it can be used on pretty much any texture base which is great for those who may not have the particular texture you are using or who want to use a different texture than you had in mind. I'm surprised that a lot more of the texture based items aren't put out as photoshop/paintshop pro layers.
