Subject: ATTN ClintH: Please Close Out My WHOLE Store Immediately.

Dear Clint. I see no reason to go on financially supporting a site that is run by a man who can not treat me with a minimum of human dignity, respect, nor even go so far as to provide the bare minimum of support to me as a merchant on an equal basis with all merchants. Due to having been banned from the Merchants Forum here by Tim Choate for no reason other than the fact that I own PoserPros, I wish my WHOLE store closed. Every product removed immediately. That would be: Kailey Flutterbye Wysteria with Hair Delilah Saluda In my time here I have made in excess of $20,000 dollars as a merchant. There was a time when I did not begrudge Renderosity one single penny of it's take on my products since I received value for Renderosity's services toward me. Now though, all I get is hate and prejudice and animosity and banning from a forum I as a merchant in good standing have a right to participate in. If I had been denied access based on being a day to day disruption of some sort, or some flaw in my conduct, that could be excusable. But to merely deny me access because I am the owner of PoserPros is inexcusable conduct and a breech of contract with me as a merchant in good standing and therefore in an active business partner with Renderosity. Please remove all of my products posthaste. I will be checking back within the hour to see that they are removed. Thank You. Mehndi - PoserPros Owner and Boutique Manager

Not bye yet Aardvark, my store has not yet been removed. Heh, selling better than it has in quite some time today, ever since I asked it be removed. Maybe that explains the delay in removing it? Sucking every last dime off me they can.

Mehndi - An E-Mail was sent to you explaining why your products havent completely been removed, yet. One product has been removed and that is the one that you didnt have a co-creator listed on. The other products will be removed once we receive approval from the other merchants that are listed as co-creators. FYI, Clint

Mehndi, I have removed Saluda since I received the approval from Jaager this morning when I checked my E-Mail. I havent heard from Thorne, yet. When I do that product will be removed. The other product will be removed on 11/23/02 as I indicated in the E-mail. It must fulfill its 30 day commitment as outlined in the Merchant Resource Center. This is to cover testers time and admin overhead when releaseing a product into the MarketPlace. I received the approval from FaieriGurl and will remove it after the 30 day commitment. Uhm actually when you violated Mehndi's right as a merchant to access a forum that all merchant's were promised access to you breeched any agreement with her and - therefore you get to eat the costs there Clint. If her products aren't removed when requested due to the unethical, unprofessional and discriminatory decision of Renderosity - you could be legally "entitled" to give her 100% of her profits. Constantly 'rosity believes that as a private company/community they aren't liable under discriminatory law and unethical business practice - you are. Sure you can ban and accept whatever members you choose, but you can not discriminate against a certain "level" of membership as you are doing now. One is "Merchant level" or they are not. Mehndi could easily file a lawsuit stating that you undermined her business here while showing favortism to others - this is unethical in any business and comes down to being a legal matter. Would be a lot easier to remove her products now, she has ordered you to cease and desist. Technically you have to do that. If you decide to push for the 30 days you can sue for your right to do so and then replace the items. Of course for a few bucks Mehndi could get a "legalese" Cease & Desist order against Renderosity and have it served via the police dept (for free if needed) first thing Monday morning. Depends on how 'rosity wants to play this.

Just an outsider's POV, but, if R'osity can change the Merchant Agreement without prior notice, then why must merchants be held accountable to uphold the 30 day minimum requirement for their products to be in the MarketPlace in light of the changes? Seems to me that there are double-standards in place in which R'osity recieves the benefits while the Merchants recieve the shaft. IIRC, if one party breaks an agreement ("breach of contract"), then all agreements and restrictions are off. Therefore, it would behoove R'osity to rethink enforcing the 30 day restriction, unless they would like to invite possible litigation into an already adversarial situation.

If R'osity wants to cut merchants out, then R'osity ALONE is required to bear the financil consiquences of their actions. This matter needs to be resolved NOW! Merchants are bailing out of this place, it's like watching a ship sink here. Familiar with the term Flotsam and Jetsem?

As you have been told Clint, Kailey was released here in EARLY september. Over 2 months ago. You CANNOT use a minor update of a small texture change to hold her as your hostage. Delete her NOW!!!!!!!! She is not yours! How dare you people hold my products hostage due to even the most minor update we have done to keep our customers products up to date! YOUR store has breeched contract with me. Immediately remove my products. I have no more obligation to you.

I suggest you contact a lawer immediately Mehndi. As for refunding money to customers.. they won't do that. When when one merchant steals another merchants work and sells it they don't refund so I think you have no chance.

I'm seriously beginning to wonder if I want to do business with a company that appears to be so unprofessional and inconsistant. Mehndi and Shawn are right. Renderosity violated the agreement by locking her out of a forum where discussions impacted her product and income. (why the PTB can't wrap their minds around this is beyond me) Legally, Renderosity is in a very precarious position here and really shouldn't push it.

Actually Mehndi you may very well be entitled to 100% of the sales as 'rosity no longer has a right to distribute your products - that means they will even have to eat the costs of the processing fees and your legal fees in this matter. Want a cease and desist order form? I should have one here lying about somewhere...

I must say....ClintH, do you know how BAD you came off looking to the whole community for not releasing Mehndi's products in a timely manner? Not to mention the snide little "have a fantastic day" closing in your earlier correspondence, just made you look petty and small. if this is a business, and plans to be a big business, this is not the way to treat people. by doing things with a little style, you could have saved yourself from making a complete enemy. after all....this big random group of users does constitute a net community, and, i am sure you and mehndi will have, in some future time, occasions where it may be advantageous to each of you to remain civil.

First off, I want to appologize if I came off as snide. I didnt mean to. Really. I think those of you who know and have worked with me know that wasnt what I meant. I simply always try to have a smile on my face and say Have a nice day to pretty much everyone I communicate with on the net and in person. But, I dont think it was the proper place for it..this time. I did come across that way and Mehndi, I appologize for that. Mehndi and I go way back and I have always wished her and Russ the best with their new site. As far as the timely manner. Well - I try really hard to be here at Renderosity as much as I can. I for one will NOT be purchasing any more from Renderosity, nor will I participate in the forums. Renderosity was going down the tubes before this, it will not bottom out fairly soon.. Clint While I can understand your understress with this whole situation, this was the time to act proffessionally and make absolute sure you did. Your attitude in this thread seemed very cold and callous and while Ihope that this is not waht you planned.I do hope that in the future this kind of situation will be handled much better than it looks in this thread.

Knowing Clint as well as I do, I know Clint to be very open, honest and tries to be really friendly (even with me and our pasts together)... He made a mistake and poor timing and might even be just as frustrated as the rest of us regarding the current situations going on here. He works hard and doesn't get rewarded as much and is in a, pretty much, thankless job... let's please, give him the benefit of the doubt and focus our own frustration with the situations affecting this place, the merchants and Community in the area it is deserved... which isn't Clint. He works hard and doesn't get rewarded as much and is in a, pretty much, thankless job... that could apply to alot of folks. but, forgiveness is free, as long as he does not become a repeat offender. i just wish he had more courage. courage to do what is morally right. renderosity is not the only job in town. and, if it is thankless....well, for a thankless job, he didn't have to speak so cruelly.

I have to add something to this conversation. I have yelled SOS to Clint so many times I lost count and he has ALWAYS been very kind and very patient with me and never once had a rude remark.

Thank you for your apology Clint. I can tell it was well meant, and it is well taken. Clint and I go way back, and even through strained times have managed to hold onto friendship between us. These times are strained for both of us, but I believe that our friendship is genuine, and will provide a lasting buffer safe zone against destroying our long lasting close relationship. I do realize Clint is in a very bad situation at this time.

I am not saying that he isn't a nice guy. I have defended him many times about this kind of thing. I said he seems to be.. I know he's not. We all know he's not, but this is one of those instances where everyone needed to stop and think about everything before they posted. In this issue unfortunantly he comes off looking really bad. Which I know he did not mean to. Clint's a great guy. I know he is. He's been nothing but helpful to me. I have never had a problem with him. And unfortunantly he's been caught in this situation without a true escape. However, I would like to add that the compassion I feel for Clint in this situation is diminished by the fact that he could indeed find someplace else to work. Staying on in a corrupt organization when he sees it is doing wrong is his own choice, and it will eventually ruin his reputation.

don't normally post to these types of threads as they generally don't accomplish much. however, at this time i just wanted to share my thoughts. . . not specifically relating to this topic, but this is as good a place as any, i suppose to share them. it is my sincerest wish is that everyone get exactly what they deserve. i mean that. let's all hope that what we sow comes back to us tenfold, an amplification of our heart's true intent. what can be better than that, hey? ~~~~~~~~~ and for the record, i think clint is an amazing individual, whose personal and professional integrity has always been a shining example. i am proud to work with him even in the limited capacity i do. i would be hard pressed to find anyone else i trust more or would want by my side in times of crisis. thanks clint.

You should try reading what 99% of what the members and merchants have been saying. We're just trying to get some common sense across and instead we're seeing admins acting like children instead of responding to direct concerns.

It's like the children have taken over and the adults are trying to teach them to behave but they'd rather run around with their hands on their ears screaming 'nya, nya, nya'.

You've comported yourself here in a forceful yet reasonably polite way so far in this situation, aiming your remarks at the site and administration in general. No more uncalled for than Audre's remarks which preceeded mine, nor her conduct toward Russell and myself in the past, and now, as well as the conduct of the admins of this site toward us, and the owners of this site towards us. They cannot expect us to have warm happy fuzzy feelings toward them after this. This goes both ways, their actions. They set out to see us as enemies and they just may make enemies where none existed before.

Jack, thanks. Maybe I should learn my numbers better ;) Mehndi, audre's comments were made as a general statement in relation to this whole issue. I didn't see anything that said Mehndi should get anything tenfold or bad. As for past issues, how does dragging them up help now? I'm not going to speak to the "... conduct of the admins of this site toward us, and the owners of this site towards us." since that's not what I'm about here. I'm simply asking you to keep the argument directed at principles, policies and the site, not individuals. Thanks, Kevin.
