Hi guys...this image is a screen shot I took to inform some friends here who's images have been post, I think most of them without our permission,in this web site, starting from this page: http://s40.photobucket.com/albums/e229/fractalmaker2080/?start=460 and the following... a friend of mine explained me: Photobucket is only a photo album, a collection of images where you can store them for free in an album.If person owning the album is only storing the images to view for themselves and isn't linking them to another website and only storing the images there's been no crime made. Probably she is right...but looking at the page you can see there are URL LINK,HTML TAG and IMG CODE to post the images on the web!??!?!!?...so I think anyone, as I did with NO obliged account, can copy and paste the images wherever they want!?!?!??!?!...I think I'm missing something...isn't this a copyright violation?!?! PLEASE EXPLAIN ME!!!!'CAUSE THE WEB SITE INVOLVED DIDN'T ANSWER my mail AND THE IMAGES ARE STILL THERE!!! Yeah, once they are in Photobucket anyone can come along and left-click to remove them-- so they don't have to have any account like on Rosity. I'm not sure how you would fix this exept ask the Photobucket account holder to take them down?

well, yes PB is to keep images. and the wecodes id to post t blogs or somewhere else. maybe share them with friends. "THE ARTIST I CLEARLY RECOGNISED, ('CAUSE THERE IS ALSO OUR SIGNATURE in some images!!!!!)ARE THE FOLLOWING" so whats the problem? i have seen 1000 of copys from the mona lisa on the net. if u put your pics online its normal that they are apear on the net don't u think??? thats just funny for me what u wrote here, sorry.

I agree that this is an issue. And here is why... The TOS here at R'osity clearly state that the images we post to this site are for personal viewing only. The rights still remain with the artist. In plain words, the copyright violation that is taking place is that the images have been downloaded from R'osity and then REPOSTED to another server for public viewing/consumption--without the artist's consent. By doing this, the person/people taking the image have violated the copyright of the originating artist. The electronic copyright laws allow for the image to be copied to the hard drive of the viewer (as it must be in order to display in the web browser), but do not grant permission to use the image on another website--particularly when the opportunity to purchase print products with these images is available. The practicalities of how to enforce these copyright laws is still hugely debated, since web designers routinely rip off code and/or textures etc from other sites. Many/most public blogging and forum systems don't have any objection to people utilizing images, videos etc that they have gleaned from other sites on the web. So, the bummer side of this is that if we post our images here, we have zero guarantee that someone won't steal them. The only consolation prize that one can take is to feel somewhat honored that one's work was good enough for someone else to steal. I think that's what you call a "backhanded compliment".

Most people think that if it's on the internet, it's fair game. And they really don't care whose work they take... I see it all the time coming through my groups and I usually write the person and say, that's someone's image and you need permission... but they don't care. =/

The things with the Mona Lisa is that is was done before copyright laws were created over a century later. It (like all of the works displayed at the Louvre) are considered to be in the public domain. That doesn't mean anyoen can do anything they want with them, but reproductions are allowed and I would think that posting a digital copy of the Mona Lisa is covered by this. What we see here are images that DO fall under copyright. If this PB album is publicly available and has images from others without permission, it's in violation. It doesn't matter if the persoon who created it doesn't post links to it elsewhere and only intends to use it for themselves. It can be accessed by anyone whenever they want, and the pictures can be spread. Unfortunately, it usually comes down to the artist(s) themselves to take action if their work is used elsewhere without their permission and they want it removed. Then again, I'm no expert, so you may want to bring this up on the copyright forum, if you haven't already done so.

Many thanks for posting this. As far as I am aware to post on the web whether it is said to be a private album or not is a copyright violation of work that the perpetrator does not own. If permission was not sought from the owners of these works it is a clear infringement. If permission was given that should be clearly stated and the owner credited. A private album should be just that for private viewing only!

Thank you Lara, for going to all the trouble of bringing all this to our notice. Unfortunately, as I see this, there is very little that can be done about this disgrafeul behaviour. In my view, there is not one ounce of integrity in the individual who has taken this work and re-distributed it. In my view, they have committed a theft and have used and re-distributed these images without the owners' express permission. I would hope that there is someone out there with sufficient money to go after these low lifes, to stop this once and for all. There are losers out there, using the work on here to make money. That to me is totally wrong. Steve :o)

Thank you Lara to warn, certainly is a risk that we assume when being in the net, there is not any security that the material that we are exposing is not stolen, nobody guarantees us that this doesn't happen. The violation of the royalties and offering material of a personal gallery gratuitously without doubts is serious, and it is contradicted with the confidential politics that should have an address that is supposed she offers a gratuitous place to put a personal gallery, without doubts they take without permission what doesn't correspond them, to my and I believe that to the rest of the artists they didn't consult us if we gave the authorization to redistribute the material, they didn't make it for that would have to pay enough money. Regrettably I believe that we are tied of feet and hands, I don't really know that we can make.

I agree with what Aralt3 is saying. It is one thing to take and put on Photobucket and sell prints of someone's work it isn't right nor fair to the artist unless some type of Proceed is taken for someone using an artist's hard work in the intent to sell. I hope you get what I am meaning. But on the flip side, can it be proven that someone is putting the art work on Photobucket in the intent of sale? I am not sure of this myself. It may have to be taken up with the owners of Photobucket. I personally use Photobucket for pictures that I have taken for the img coding to beable to put the pictures in forums. Its just one of those things I am unsure of when it comes to your specific predicament. I hope anything I have said will be helpful.

Hi Lara, thanks for the information, i just viewed the album and yes my pic is there along with loads of others here at rendo, I recognised one fron donakuka and christell too, no permission was given for my pic to go on there and would imagine its the same with all those images. it was taken before is started doing the banners, so its probably been on there for months!!! one concelation is that if he/she does remove them then all the linked webs will have a blank screen as its hotlinked to the photobucket using that embedded image tag thing, thing is how the hell do you get a person who obviously doesnt give a toss about our rights to remove them, the "print" button has seriously P***ed me off and ive written a short email to the company (couldnt find the individiuals details ) asking for removal with immediate effect and the banning of the user of the album, the company have also violated our copyrights, they are the ones printing the images and act on behalf of the user, although they probably have a disclaimer somewhere, I wrote this, .....Re http://s40.photobucket.com/albums/e229/fractalmaker2080/?action=view&current=InTheBellTower-Lully.jpg This is a violation of my copyrights, I am the original artist of the image concerned and I have NOT given the user of this album permission to take my work!!! I want this removed with immediate effect and the user of the album banned from your site, he/she has not only violated my copyrights but also several of the artists at the Renderosity community. By allowing prints of these works you as a company are also violating MY terms so I would suggest the removal with immediate effect!!!! ........lets wait and see :o( other than that we should all sue the pants off them!!

Ohh, ma puce, encore une page qui faut faire sauter??? LOL... Je viens juste de m'inscrire pour voir la partie photos et image et je peux te dire que va jaser dur avec tatie Valou LOL... En lus de j'ai une excellent moire, tu te rappelles il y a quelques moi que je t'avais envoyer un im pour te dire qu'un membre de rr avait voler une de tes images? Ben oui, valou a une moire d'hant et la rage d'un tigre quand il s'agit de voleur d'art, et tu me connais :)))) En tout cas, il est vrai que si on ne veut pas re victime de , il suffit de ne rien mettre sur la web, mais si on s'unissait un peu tous on n'arriverais peut-re fermer ou chasser ces stilem men/women de la web... Malheureusement ma belle, c'est pas la premie fois et ni la dernie fois que nous sommes victimes de ces actes. Bon allez, maintenant, je vais faire chasseuse d'image LOLLLLLLL.... Thanks for this, Lara. You are absolutely right! But many peoples hands are tied. Unfortunately, this is the chance we all take when we post anything to the net. Anyone who saves an image posted here and re-ups is in violation of the artists rights to the image, whether they want money or not!! To me, RR is the one who has the power to do something, even though their rights aren't the ones being violated. Scott

NOT HAPPY !!! Myself and Riguel have also been ripped off !!!, but the only recourse is to send them a stern letter and ask them remove your image and threaten them with legal action... if you want to know more about copyright law check this out Meredith_Wilson 0268, post here at Rendo I hope this will help some artists here, Thanx Lara for opening our eyes !
