My dear friends, many of you already know that the episode Canals Of New Mars : All You Need Is Love, had been removed by Renderosity Admistration, because of TOS violation. First I'd like to say that I understand the concerns of the site webmasters and administrators standing against bigothry and possible law suits. I agree also with the TOS Guidelines, as far as I understand them. But I've some problems to understand the applicative interpretation of the TOS Guidelines. Who decides? What are the evidence based criteria for removing a work? The proofs have to be only circumstantial, do they? For example: The moderator suggested me to move backward the two characters. Since I'm a consultant for the Public Attorney in Padua and for this reason I cooperate with some US Law Firms, I wondered "How many inches?" in order not to be found guilty twice and banned as recidivist. Remember the Lewinsky affaire. Are the moderators aware of the cultural differences in their statements? I'm wondering about it because, in my opinion, there are a lot of sexist stuff exposed in RR with no blame at all. In the exchanged mails who resulted in my first official ammonition, the chairperson (moderator?) who represented Renderosity in front of me, NEVER showed the will of understanding that different cultures and different legal systems can render very difficult the correct understanding of the US Laws (or what that chairperson pretended to be the US Laws). Neither this person showed the intention of opening a forum on the censorship problem which is very requested here in RR. Since it seemed to me that this chairperson was judge, jury and hangman in my "trial", I felt the statement that "regardless to your feelings" this is my opinion, take it or live it, culturally very inappropriate, insensitive and ethnocentric. Cultural callousness is a "crime" in a site that proudly presents itself as multicultural. Since I never retreat from a battlefield, privately I'll send a mail with the address of the website where I posted the removed episode to anyone who askes for. In the future, in order to avoid such accidents, I will post on Renderosity the Bigots Version and the Director's Cut Version in another web site privately sending the addresses to anybody who asks for it. Even if some Popes had nothing to say about it, bigots put big underpants also on the the anguished, writhing, tormented souls in Michelangelo�s �The Last Judgment� over the altar of the Sistine Chapel. After that, who am I to be offended!!!

Interesting, but in my experience (several warnings and a 3 day ban) the moderators are other members, like us, who have been hired by the website's operators to assist in policing the many pictures posted every day. (Check out the "About Us" tab at the top of the web page) I wholeheartedly agree with their terms of service, because, since the site is freely available, that they have a legal obligation to prevent improper images to be viewed by minors. Since they can be held accountable for the pictures we upload, they must take action to control the content. Next, since they receive approximately 500 to 1500 pictures every day (and this is just a rough guess), they need to err on the side of caution. That means their moderators are probably given strict instructions that if it looks questionable, then they should yank it, pending a review. Remember, Rendo is a buisness, and they support the galleries because it gives their consumers a place to display the products they have bought from them. That being said, if we want to keep Rendo a viable place for us to display our artwork, we should support their efforts at maintaining the site. So if we can't have 'boobies' in our thumbnails, then put something else on your thumbnail! But that's just my opinion... I could be wrong. Tom

I found your work wonderfully esthetic! I could not find anything offensive in this work!!!! With many other work, on which I came by accident, completely “other things” are to be seen. But no “judge” seems there to intervene. Nepotism?? And because of the moral? In your marvelous work I could not see anything immoral! On the contrary!!!!! Let's get the facts straight here. When you join Renderosity, you agree to abide by the Terms of Service Agreement. The staff reviews any potential violations as a GROUP. Interpretation of the Terms of Service is done by the staff as a group. This includes Coordinators, Moderators and Administrators. Much like the legal profession, we follow a set of standards and precedence. The staff here is a versatile one and we have staff members from around the globe, so we are well aware of cultural differences. However, with that being said, we are bound to work with the set of guidelines we are given, the Terms of Service Agreement. Legal variations around the globe are not relevant here. Renderosity follows international standards with regards to Copyrights. Since the physical location of the site is in the state of Tennessee in the US, those are the set of LAWS they are bound to. I will suggest you tread with some caution when using the term bigot. The staff here works very hard at being fair to all members.

A very interesting debate is raging, i love your work, it is imaginative, creative and superbly done, i am not sitting on the fence here, but the TOS are designed to protect everyone, i have had things pulled up by the mods, this is when i have made mistakes, me, mainly as i have not done things that are cleary in the terms. MY mistakes.My fault. I saw the image you posted and left a comment, to my mind it was a lovely tender image, very nicely rendered, but to be fair, it did break the tos.What do we do, we learn by our mistakes,i now try to post within the guidlines because at the end of the day Rendo is a great site and a wonderful community. Please do not take this as a criticism of your opinion. Just my view on things, i will continue to support your lovely work, why, because i love it. Ian

My dear pushingfaders, thank you for your kind words. I'm happy to know that all of you saw my work and decided to remove it. This way I know that you are well informed about the matter. As I told above and in my e-mails I agreed and agree with TOS and, BTW, with Seaview123. In fact usually I don't put naked private parts in my work. As you know No private parts were at view in my image. That said, I know that in the US Courts the defence is granted and it is granted that the suspect had well understood his rights (Miranda Sentence). Well if there is some problem or the defendant asks for advice as in my case, is there any councellor for me/us in Renderosity team group? The ban needs all the people in the jury say yes or the majority is enough? I want to be honest. I'm not interested in changing your sentence, the image is already posted the Dutch website http://www.target-view.com. I'd only like to understand well how your workings work, because I like RR and I'd like to go on with happy relations as it was so far. I well understand that all of you work a lot for the site and I appreciate it and you know that I was ready to change the image, but I was ticketed because I dared to post your (of the GROUP) sentence and my counterclaims for the appeal. I find very strange that the motivation of a removal was "classified" as it was in my case. This way it's impossible to debate, and from what I can see you host forums. As to the word "bigot" in Italy it simply means old church goers in lay everyday speech, it's used in a benign, ironical way. The insulting word is "fascist", and you can understand why. I don't know if the English term has a worse meaning, if it is, I'm sorry I didn't intend to offend anyone. But I must say that by removing my picture and classifying the motivations, you inferred that I am a pornographer! That after decades of fighting against the sexist use of womens' bodies. And frankly, this is politically worse. I've read 2121's comment. Don't worry my friend, no offence taken. Instead I must say that if we want to learn from our mistakes, we have to speak, to discuss, to explain, to post forums. Just for your knoledge, I tried the rendering of the image with bath suits on both characters, from that POV it was impossible to see them. In this case what is the recipe? change the POV and the artistic view or put two images the artistic one and another camera's view just to show that they aren't naked? That is a problem I want to discuus about. If my ammonition starts a debate or a forum on this issue, on cultural differences, how to avoid pornography and preserve art and so on, I'm happy to be the lamb. In fact that is what I wanted not just legal terms, I'm feed up with that at work.

As I saw the image, there was no sign of penetration or any other overt act of sex other that the top view of two people, one with her legs wrapped around the waist of the other. That being said, the US has a moral dichotomy when it comes to sex, or rather a moral hypocrisy! We would allow our children to watch all types of violence on TV without the slightest qualm, but watch out if a flash of boob is shown: Moral outrage! It boggles the mind, it really does! In the interim, we must abide by the rules and if we have a question, I guess we submit to the staff and let them decide.

Dear friend I have had images of mine temporarily removed because of nudity that I had not classified as such (nor would I normally classify them as that). Then I received an e-mail warning me because I was classifying them as nudity when they were not. I still cannot clearly discern between the two cases. With me, the moderators have always been polite, but never objective about exactly what is or not to be labeled as adult content. Being Brazilian, I'm sure my perspective is different from theirs, but I have no idea precisely in what way. The best thing to do, I think, is to try to go along with what the moderators request in the best way possible (it is their site after all)and simply post elsewhere whatever is not acceptable here. Don't take the comments personally. I empathize with your objections and with you call for clearer guidelines, along with some open discussions about them. But we do what we must.

I didn't see the posting. I do know that moderators have to follow strict guidelines. Think of the consequences if Renderosity were involved in a court case started by someone. The costs could be enormous. Playboy has a long history of fighting in court to prevent what I call the tyranny of the minority. They have, I believe, never lost a case but it has been very costly. A similar thing happening to Renderosity might result in the end of Renderosity since I doubt their pockets are as deep as Hugh Hefner's are. I would prefer they do not take such risks. Perhaps something offensive right now might become postable in a few years. North America still has a distance to go to escape the effects of censorship. Moderators at a particular ship photo site must reject any photo that does not show the entire ship. Can you imagine how many creative photos of portions of ships that were deleted? Several of mine went down the tube, and I deleted the rest and went elsewhere. But I was not angry! It was a free site, those were the rules they made and I was prepared to live with them. I still visit once in a while but I no longer post there. Most photos showing an entire ship are quite boring. I have found ship photography enjoyable but mostly to shoot parts that were interesting for one reason or another. There are few good photos there anymore except for those with severe weather.

first i would like to express my hope that you will stay with us in the community,man i am addicted to new mars-hehehe. as for the tos,i had a couple of issues -my fault it was ,and i came along pretty good with the staff,we exchanged sitemails i reduxed my images and since then all ok. as i pose mostly nude (not me ) the characters-lol i always try to keep em as far away from each other as possible while not destructing the scene. america is different then europe,i knew all about sex on the technical point even all the diseases (except aids in that time i am speaking of 1967-1968)because my mother facilitated me some books where the technical and biological issues where discussed. so i had no problems or complexes in that way. in the states i think that people hardly mention sex in front of their kids but wait when the lights are outor behind closed doors ,no disrespect,but thats the way the grow up.. should maybe change the educational system a little. we are more open in europe when we have private problems we talk to our partners we dont need a shrink to sit besides us and lead the discussion for things wich are in no way of his business,but i think i am going out of the story here ,it just carries me away. marital problems ,we take a beer and sit with our partner and disuss it,no need to pay someone to counsel me man, i come from the streets i handle myself. but one thing please lets be in contact and stay here .and for links of new images wich you cannot post here sitemail me or i give you my private mail. your art means a lot to me brother. to all a nice weekend and go by the TOS. greets to the rr staff as well,i know the world is getting more and more complicated by the second.

Mmm. I viewed the image, and though the composition was suggestive I did not feel it contravened the TOS. What does concern me, however, is the sudden increase in images being removed. I have noticed, this week, that a number of my friends images have been removed. Do we have a new moderator by any chance? Someone with a different perspective of what the TOS means. It is strange that there is a sudden increase this week. Well, I look forward to your next image and trust this disappointing episode has not affected your desire to post here.

What brain cell thought of that... It's a complicated debate. I am against any kind of censorship in art but I am in favor of that laws are enforced. Perhaps the question comes derived from the eternal double morality. I know many people who are against pornography in public but is consumed in private . False Puritanism? In any case I've seen and read your work and find nothing offensive, if art is a form of expression and describe a natural situation among people in the way you do, sensual but not obscene what is the problem? In short, long ago I do not understand what is happening in society. First we fight for our rights and when we have them we fight for not allowing the people to use them. Great idea!!

There will never be a clear version of TOS anywhere...the reason is the language that is used to make the rules will be interpreted by each person who reads it according to their personal understanding of it and usually there then lies debate within debate...I understand the need to protect our children but the protection lies in the hand of the parent, the parent must be knowledgeable about the situation and then teach their children accordingly. In simpler terms, honesty is always the best policy and when parents do not teach their children about their bodies it then becomes a subject taught by other children or the schools or both...thus there is a confusion created by the lack of knowledge handed out in a loving and supportive way. I read all of these comments and some are clearly knowledgeable and others are written in fear or from how they learned in a not so positive way. Everyone is entitled to their own opinion but everyone seems to think their opinion is the right one...confused? me too! Every day I see the law here is not clear...example...there is a street sign that says one way, the police drive by and see someone turn up the street the wrong way and see this same person do this day after day and yet no ticket is given...so why is the law written if one is not going to enforce it? Or why do they enforce it one day but not the next? I realize that this example has veered off from the TOS debate, I offer it only as a way of seeing how confusing things are. Your works are fine works and I enjoy them immensely and your writing is wonderful, you write what you know about and that has to be a good thing! The added imagination is a bonus! Keep doing what you do Flavia. The only thing I would do as I alluded to in my email to you, is don't take the argument public:-)
