Subject: The constraints of art

Seeing as how people actually want me to link to my pictures, on this occassion I'm going to.... but there is a reason. Like other artists both here and on other sites, in a bid to get around the fact that I haven't got nude models at my beck and call, I use pics of ladies from errrr.... "other" sites. Last night I created a picture that I considered to be my best yet. Unfortunately, I also felt I had to change it before posting it, and after doing so have posted the version you see here, which, to be honest, I like but I'm not as *happy* with it. Why should I do such a thing? Quite simple. I chose a picture of a model for the pose and the tone of it. The girl in the picture was obviously old enough for the photo but she wasn't (how can I put this?) erm... she wasn't exactly Pamela Anderson in the jahoobie dept. When I finished the picture though, the effects I used layered over her left her looking younger than her years, but not by much. Unfortunately, I felt this to be enough for me to refrain from posting it and spending a bit of time tonight re-creating the girl section with an older model, purely to prevent any speculation on the fact. Shame that society is this way enough to make this a concious decision. (",)

OK. So what was the problem. She is old enough. BUT you made her look younger THEN deciced that she looked too you. So you made her look older!? MAN you are a confused person. Jordy! As is our society. Can you cheat and replace her head with another models head which looks in the correct age range. I'm sure you have both the tools and talent to do this. Just a sugesstion. HOWEVER the picture seems fine to me as is. bsteph

First off, it is beautiful work, Jordy. You bring up several serious issues. I hesitate to jump in here, as I also fear this thread could turn into some righteous flaming, and that would be unfortunate as the issues would be lost. You seem most concerned about the age of the model, and not wanting this to be missinterpreted as child pornography. The laws here in the States are very conservative in this matter. It is best for the photographer to be very conservative also; asking for proof of age from their models, photographing their driver's license, etc. The Federal Supreme Court has also ruled that using adult models portrayed as children is also illegal. Having proof of the model's age leads us directly into another serious issue. How could you prove the model's age having "borrowed" the image from an Internet site? This work includes a recognizable person, who may make a legitimate argument that you have somehow violated her privacy or in some way lessened her rightful income. It would be difficult for you to argue that you took this photo as a "candid" in a public place, even if that would be a legitimate defense in using a person's picture without permission. Since yours is a derived work of a recognizable image, the photographer of the original image would also seem to have a claim of copyright infringement. These are tough issues. Enough to scare many away from street photography (though I think Don is safe; public event, newsworthy...) When you get into something that even sniffs of pornography you get on a very slippery slope. Photographers, and artists of all types, have used images of people, people's houses, people's garbage, or whatever for practically forever. Usually without model releases or permission. But be aware that you can get into trouble. Maybe serious trouble. [Alpha at one time here posted a model release template for all to use.] As for derived works and copyright; all I can say is the field is mucky. Maybe try the Copyright Forum. The third issue is just to remind folks that some Corporations take a VERY dim view of anything REMOTELY resembling pornography. If I had opened the link to your beautiful work from my office, I would very likely be fired tomorrow. I am very careful never to visit Renderosity while at work, or absolutely never post anything to 'rendo from my office, or store any images on company owned computing equipment. My Fortune 200 employer has a "zero tolerance" policy in this, as many others do also. They have "snoops" monitoring all Internet access, and e-mail. I only bring this last issue up, as this zero tolerance policy came as a great surprise to a close friend of mine, who, after 25 years of loyal service was marched to the door without even a chance to clean out his desk. Zero tolerance, (and I think this is sad), is actually that, ZERO.

The image is very nice work Jordy...I'm to confused about what the other issues you were concerned about were to make intelligent comment on that...I think bsteph and Misha have covered any angles far better than I could! @Misha ...gee mate! after 25 years of loyal service was marched to the door without even a chance to clean out his desk ~ Fortune 200? A company worth heaps of money? Ahhh, as my wise mother-in-law has been known to say "You can tell what God really thinks of money...look at some of the assholes he/she gives it to" ;-)>

Jordy, image is very nice. But, mymymy, are we speaking about copyright law violation, or where did you get the girlie? Porn sites doesn't got free pics, even as they say it in every damned popup window. (joke, gotit folx?) Learn to manage with your own images, or use free sharevare images only when you can be absolutely sure those images are free. I know, it's hard to get good model shots, but when you do, you're gonna respect yourself more. Oh, and in this case, girl doesn't look too young. Dont worry bud. .n

Like I say in my orig. post, it's not the girl in this image. It is the girl in the original version of this image. This is the safe one........ Oh, and Niko, how come you're so well up on porn sites? I never mentioned them - I didn't get them from a porn site anyhows......I'm not giving them MONEY!!! - you dirty monkey...... my only alternative is to sweet-talk our lass into posing then flood you with different pics of her..... unless you guys have got legit. pics you wanna donate to me? 'Chelle? Shufty? Guys with girlfriends? wives? etc etc? eh? eh? And Misha, I well believe it. In my previous company one of the most over-worked depts. had internet access. This dept was always being got at for being short staffed and behind, but the company still got rid of 40 people in one shot for having images from rotten.com in their e-mails. (",)
