Please help host? The Zip is just 493 KB. Still working on a way to distribute Buffy, pictured here...the combined efforts of RogueElement and myself.

I hope you can find a way to distribute Buffy. She's great!

HOLY COW! Those figs are just amazing! Does the Spike morph also include a body MOR pose file to make the build accurate?

Remember, kids! Napalm is Nature's Toothpaste!

Photopium ( ) posted Sun, 02 March 2003 at 3:22 AM

yes and no... I used DAZ's "Idol" body from the Male Morph Pack, which the injection pose file is happy to inject :) -WTB

Oh, I know I'm going to get flamed for mentioning this, but is anyone going to have problems with copyright infringements if they use these models? If they are advertised as Spike and Buffy (and they certainly do look remarkably like them), I'd have concern about using them...so far, the Buffy people have been somewhat intolerant of copyright infringements, from what I've heard. I know Buffy is going off the air, but that doesn't mean the ownership of the copyright/trademark of the characters has been released. I don't know...I'm just asking. I'm not trying to ruin anyone's fun...just wondering.

Nance ( ) posted Sun, 02 March 2003 at 3:20 PM

BURN'EM! ;-) Ok, seriously though, why would you consider that these characters would be regarded any differently than the zillion of other celebrity fan art figures that have been posted. Star Wars, Star Trek, Comic book heros etc.?

dialyn ( ) posted Sun, 02 March 2003 at 3:27 PM

Actually I have the same question about any of the models for which permission from copyright holders is not granted before turning them into models. I haven't asked before because I suspected I could anticipate the response...but the question is still out there and I was curious. And I know someone will say that because the model is being given away, then it is just fine...but that's really not how copyright goes, from my understanding of it. But I also realize I don't know everyhting about copyright. Just curious if anyone here does.

Creating the Buffy & Spike figures isn't a copyright violation. *Distributing* those figures is & you can be sued in civil or even criminal court depending on the circumstances. here is a link to the "crackdown" on Buffy fansites... http://www.wired.com/news/business/0,1367,34563,00.html and a link to one of the "cease & desist" letters from Fox... http://www.moorstation.org/typoasis/cwars/buff.html and Nance, technically ALL fan fiction, if done w/o permission violates copyright. It just depends on who it is as to how vigorous they are in defending it. See Q&A #6 in the attached link

Thanks, Cooler. I wasn't sure where all that was at now. Spike and Buffy do look excellent above. I can't use them but you really didn't a great job developing a likeness to the actors.

Photopium ( ) posted Mon, 03 March 2003 at 2:42 AM

Go get 'em. Thanks to Cimerone for no nonsense hosting :) Enjoy. Read the read me -WTB

You may want to check in on "Right to Privacy" and "Right to Publicity" vs copyright for celebrity models. It is not the same as Copyright.

CyberStretch ( ) posted Tue, 04 March 2003 at 3:45 PM

Actually, I did more research and found that fictional characters could be Copyrighted by their creators/owners but likenesses are covered by Right to Privacy/Publicity and/or Trademark; if trademark can be claimed. So, it would depend on who is entering into the litigation.

Copyrights and Trademarks are Federal (and, in some cases, International); whereas the Right to Privacy/Publicity seem to be State Statutes (like in California), which means they may/may not be applicable in your particular locale.
