Waldomac just pointed this out to me. If you look at the box cover set image they used in their shop, 5 of the images used are mine. Nobody asked, should I sue!!!! Doesn't bother me really, nice to be associated with the program I love.

Now if that were me, I'd ask for image credits, a site link and free upgrades for life ;-)

Wonder if there's some kind of link between them and the Autofx people? Or maybe they thought the images 'came with' the Bryce package when they bought it? It's more than a bit cheeky, though, no matter what way you look at it!

ysvry ( ) posted Thu, 01 July 2004 at 11:55 AM

well you've got free live updates at least for that. otherwise sue them for what they are worth ;)

for some free stuff i made
and for almost daily fotos

orbital ( ) posted Thu, 01 July 2004 at 11:58 AM

Well I know, as it goes I've still recieved nothing from Autofx. Like I said I don't do this for money, it's just a hobby but people shouldn't take advantage. BTW Gill I see your from Rugeley, I'm from Burton on Trent and worked in Rugeley for a while a few years back, my mum lives by the reservoir at Blithfield, small world huh!

First of all.. CONGRATULATIONS! second.. oblige them to give you, like gillbrooks said, image credits, a site link and free upgrades for life ;-)

Jaymonjay ( ) posted Thu, 01 July 2004 at 2:01 PM

DAZ should've done their homework to see whose images they were using for their promo shots, and most definitely should have asked for your permission first. I'd probably settle for a nice healthy selection of stuff from their marketplace as compensation. :)

Rochr ( ) posted Thu, 01 July 2004 at 2:01 PM

Congrats, but you really shouldnt let people take advantage of you. Not even once. They are, after all, making money on the product, and if they use your images, they should most definitely pay. Email DAZ, and tell them about it. As for AutoFX, if i were you, i would demand them to pull back all the images, until payement is done. If they dont pay, sue them! Theyve had plenty of time to pay you by now and you have all the files for the images to show for.

I just got in touch with Cliff who is Autofx head honcho to see whats going on. The images on Daz's site have been lifted from the autofx site which I gave them without his permission. They've also include a piece by artist Wolfgang Sigl, which also appears on Autofx site so theirs no coincidence. Cliffs not very happy so I think I may have stirred things up a tad. @ Cog Where abouts in Burton? Did you enjoy the waft of marmite and hops that lingers around?

Prufrock81 ( ) posted Thu, 01 July 2004 at 2:14 PM

Dude this is the kind of thing you MUST address. It's not being gay to demand credit/compensation for your work. Someone will make $$ from BRYCE sales and based on the examples shown too which is YOUR WORK. Threaten to sue for retraction and compensation if they dont cough up the above suggested compensation. You DONT do it and we all suffer.

Crescent ( ) posted Thu, 01 July 2004 at 2:23 PM

Someone just pointed me to this thread. (I'm a Mod at the DAZ site.) I suspect it was a miscommunication as to what promotional images/IP came with the Bryce purchase, but I can't speak for DAZ directly - I'm not full DAZ employee. I do know that several people are now aware of the problem and will get this resolved as quickly and as fairly as possible. Thank you very much for pointing this out, Crescent DAZ3D Site Moderator

electroglyph ( ) posted Thu, 01 July 2004 at 3:01 PM

That Sucks! Before you go all postal though, it would be nice to know how they got the images. Did they filch them or did Corel sell them with Bryce? Or maybe some third party said, "Lookie here." While we're talking about selling, I have this great bridge in Brooklin.....

catlin_mc ( ) posted Thu, 01 July 2004 at 3:41 PM

I don't think it would be a good idea to "sue DAZ for all they're worth" 'cos if you do there won't be a Bryce 6. 8P But I do think you should ask for recognition and you could stop legal action if they give you a free update for the usage of. 8) It will work out right in the end, she says with fingers crossed. 8P Catlin

Looks like it's a direct lift from Autofx site see attached link. Cliff Weems is not pleased, he also promised to resolve the issue of payment for the original work, plus I have access to full product downloads on their site. I appreciate what you all say, I mean we all create stuff and in the majority of cases do so for fun and enjoy the "community" we have. But people who are in this for money shouldn't exploit our talents for their own means. I don't know the full story yet so I'm not gonna make any accusations and I'm sure the matter will be resolved. Although as a community we must be careful that people don't take advantage or as Prufock said "We all suffer" Thanks guys Joe

Rochr ( ) posted Thu, 01 July 2004 at 4:08 PM

Im sure this will be solved. But for future reference, ALWAYS make up some sort of contract for stuff like this, and make sure its signed. If its commission work, add a point where it states that you own all rights for the image/images, until you got payed.

Hi All,

We were just made aware of this thread and we immediately looked into the situation. As we were researching how Bryce was being presented on the web, the product pages were saved for reference. Somewhere along the line, images got mixed up with the ones that came with the Corel purchase.

It's now up to you. We can remove them or leave them and give you credit. Either way we would be glad to provide you with some financial compensation. We're sorry. It was an honest mistake. I guess the only good news is yours were the ones picked out as we looked for "the best".

Let us know how you would like to handle this. My email address is bryan@daz3d.com or you can call 801.495.1777.

Sincerely,

Bryan Brandenburg

Zhann ( ) posted Thu, 01 July 2004 at 6:39 PM

Go for credit and compensation, it's the same as if you were hired as an independent contractor to create the images. Any other client would have to pay and give credit.

And to top it all.....they're still not saying what else you can do in Bryce apart from the Landscapes.....no mention of the millions of things you/we make in Bryce....how many of us have made stuff that has never even seen a land/seascape? and wouldn't know what to do with one if it fell on it's head? I dream of the day when someone up there wakes up to the fact of just how virsatile Bryce is and tells the rest of the world!!!

MuddyGrub ( ) posted Thu, 01 July 2004 at 11:18 PM

I just can't believe that autofx has not compensated you for your images. Geeze, it's only software, not even money. They can't afford shipping? They could even let you download the software, if you have a fast connection that is. It's ridiculous.

My feeling is that suits are only a last resort to a civilized forum after attempts at resolving the issues have failed.

EricofSD ( ) posted Thu, 01 July 2004 at 11:54 PM

So feel free to try and resolve the issue first. If you want legal counsel during the resolution process, by all means, go for it, but filing suit is a serious thing and should not be tossed around lightly.

EricofSD ( ) posted Thu, 01 July 2004 at 11:59 PM

Since you seem to have a resolution, then good on ya mate.

orbital ( ) posted Fri, 02 July 2004 at 2:17 AM

No, no law suits. If anything I was just shocked and pleased to see my stuff used. I know it's just an honest mistake but a good one for me!

anyone know if the new Bryce will have better export capabilities? Someone PLEASE TELL ME that Bryce objects can be exported now in other formats!!! Its the ONLY limitation Bryce has that's so limiting.

ysvry ( ) posted Fri, 02 July 2004 at 9:25 PM
EricofSD ( ) posted Sat, 03 July 2004 at 3:58 AM

Prufrock, I agree, we do need better exports, but from what I understand, the primitives and booleans are render time code which means they are not exportable objects. I think it would take a rewrite of the modeler to make them exportable. That said, there is a modeling engine that is available for license that is NURBS based. I don't recall the parent company, but Rhino and EIU use it.

Erlik ( ) posted Sat, 03 July 2004 at 9:10 AM

Not Rhino anymore. They had to rewrite the code from ground up for version 3 because they lost the license. that is, somebody acquired the engine from the original company and there were problems for McNeel. But that version 2 modeller was GOOD. Render code? So it means they could use instancing like Max has? Or hair like Poser? Whoooo. Heavy. Congrats, orbital. I saw the images but never even dreamt they used them without permission.

EricofSD ( ) posted Sun, 04 July 2004 at 3:47 AM

Erlik, I didn't know that. I love the EIU modeler. Maybe it is still an idea for DAZ though. By the way, I lost the link to the web site that has the code for license. Do you recall the site or the name of the company that EIU and McNeel used?
