Subject: Technical questions about marketplace

hey everyone... :D here's the deal. I'm a 20 year old design student, I have Poser4 at home with very few DAZ3d models; and I use my aunt's computer a lot, she has a lot of Poser goodies and I play around there. I'm willing to enlarge my own poser library at home, and what I wanted to do is to make some poser stuff to sell at the marketplace. a few things though: 1. is it legal to make addons (like texture packs) for items I don't own at home, if I make them at my aunt's, using her computer, and sell them with my own account, to buy those same items with the money I earn with that, so I can install them at my home? 2. are marketplace preview renders considered "commercial"? I mean, can I used freebies marked as "non-commercial use only" in the images I use for my items at the marketplace? I think I had more to ask, but I forgot... ^_^" I'll ask when I remember. thanks a lot in advance!

There's a guy here called cooler, he's the one who knows all this legal stuff. I'd suggest you send him a PM with your questions.

  1. Items are usually licensed to the particular person who bought the item, but sometimes to the installation. It depends on the terms of the license for each item. You would need to check the license and if necessary, seek clarification from the broker.

  2. Yes, adverts and promos would be considered commercial use.

Cooler hasn't logged in since May 7th, so you would have to contact him at Daz. But I agree with Karen. Case 1 above would be a violation of the terms of use, if items not owned by Afro were transferred to a computer other than the "aunt's" computer. Case 2 would be a violation of the terms of use.

I think I'll start with a character set for Aiko then, to avoid trouble... ^^! I have her in my computer :D edit: oh, just remembered another question: if I make said character, then take it to my aunt's, and make promo images using her poser stuff (but never ever bringing those things, only the images, to my computer), then put them in the RMP, is that legal? (that only for the case of the "licence for installation")

Yes, Afro, I admire your honesty. What you are suggesting in message 5 above indicates you are doing everything according to the usual terms of use for these items. Naturally they would like you to buy your own copies of the items, but the terms of use (in general) restrict their use to a single owner's computers, and the terms of use (in general) allow family members to use items. By "family" they usually mean parents, siblings or children, but I doubt they would object to "aunts".

And you can always come to an agreement with the merchant that from the first money you gain you'll buy her/his used product no? Or start a joint-venture with your aunt?

Anyone can make a promo render for you, as long as they own the items on their computer. So your aunt (or anyone else) can make promo renders and give them to you to use as your adverts.

A joint venture is where you work with another person to create a product, and you split the results equally. IT doesn't, however, let you share files from one system to another. THe critical difference, including for DAZ files, is that they stuff is being used in a different location. If you and your aunt were in the same location, it wouldn't really be all that much of an issue. Since you have to switch locations, you'll need to purchase a copy of everything for both locations.
