Subj: heey Anton! Date: 4/14/01 4:08:58 PM Eastern Daylight Time From: daveistof@yahoo.com (da hu) To: antonk68@aol.com Heey man I think you might "know" me. It seems like your a little fanatic about warez. You know I have been sharing your stuff with my good friend Laura. Now I have a small question for you, it seems like I am missing your kickass dragon maps. I would like to have them. Now I know I should buy them but noooo! your going to mail them to me. Why you say? Well if you do not do this your greatmodels are going to be everywhere on the web for free. :) Please feel free to go to your FBI and tell them all about me. We have got connections everywhere. Unlike Laura I am not an amateur with a little kid at home, I will not cry. So Anton I am looking forward to see your maps in my runtime folder. Thanks for your time you good modeler you. Thanks in advance. zx20 :)

I just received this email. See these people for what they truely are. Any warez info can be sent to me at my email.

Anton_Kisiel ( ) posted Sat, 14 April 2001 at 10:43 PM

Hey daveistof, Excuse me if I am wrong but isn't that what you are doing now. Any damage you do will simply add to the total sum I sue Laura and Brenda for since they are the ones that provided you the models. Boy, you Warez people are sure loyal to each other. Thanks for mentioning Laura's name. I can now forward this to the police and FBI. Thanks for all your help, Anton

Oh my god that is just rediculous, ok so if he posts this warez crap everywhere, then isnt that just more to shut down? Man that is simply aweful. Dont give the stuff to him whatever you do because knowing that kind of scum he will probably post it anyways. I really dont know what to say about this message he sent but it is completely rediculous. I cannot believe how confident he is in his power, I hope he goes down for that.

Anton_Kisiel ( ) posted Sat, 14 April 2001 at 10:52 PM

To anyone who can help me positively identify this guy's real identity I will provide to you free everything I have ever made for Poser as well as everything I ever make for Poser in the future for FREE. Anonymity gaurenteed.

Anton_Kisiel ( ) posted Sat, 14 April 2001 at 11:04 PM

I will not be sending him the maps. :) So much for Laura Wagner and Benda ALexander being falsely accused.

ookami ( ) posted Sat, 14 April 2001 at 11:04 PM

Have his email address? Probably free email? You can send them a copy of the email, show them that he is engaging in illegal activity (extortion, conspiracy, etc.) and ask for a log of his login IP addresses and possibly his computer name... If you only get the IP, then you can do an LOOKUP on the IP to get the domain he is logging from. Unless he's using an anonymizer... you should be able to track him down to who he is logging on as and what internet provider. It doesn't help much if you track him down to a netzero account or some such... but it might be a place to start. His email is evidence in possible extortion charges, conspiracy, felony copyright violation, etc. Of course... unless you can track him down... it does you no good. =( Good luck!

GrayMare ( ) posted Sat, 14 April 2001 at 11:23 PM

A lookup on Yahoo doesn't get this person's profile. Get the header from the email (if you're on hotmail or many of the free services you can do that relatively easily, if on your own email system it's even easier, but if you use a client with an ISP not so simple. In the header is both the originating IP address/user and the routing addresses. Yahoo has a "report abuse" email account (I can't find it right now :P) that will help you with this. You can also read their Terms Of Service doc to help figure out how to approach them. The person has broken 5 or 6 of the "rules" with this email, even if they're spoofing the IP/email addy. http://docs.yahoo.com/info/terms/ is the TOS doc. This email suggests a person just used someone's legitimate service to commit a felony. Use that information to press charges, and if the authorities can't figure out this electronic stuff, then you should pursue it--or let one of us help. GrayMare

This email of yours is exactly the same as the one Branda and Laura gave me. It is not new. We know it is not new. I'm guessing you are from the netherlands. A student? Teacher? Something around you having to do with education. See, I know. No matter. When I find you I will stop you. I will contact every social, business, educational, contact you have. I will see you punished in your courts for your actions against all of us to the fullest extent of the law. Your emails have been forwarded. You know as well as I do that noone is untracable. I think its time for the Poser Community, those who are honest and REALLY care about its future, to band together and help Anton stamp out these stinking gangster weasels. Other Poser members who like wearing their Pollyanna rose-colored glasses and hiding their heads in the stand- there comes a time when honest and decent people stand together to stamp out scum like these people. IF YOU DON'T, they will RULE, and honest people who are artists, modelers and software programmers will all L O S E!!!... Help Anton any way you can to track these lowlife gangster thieves down. The major software companies are behind this, so don't be afraid. A lot is going on behind the scenes to help those on the side of fairness and justice. Don't help these criminals by doing NOTHING!...

I did shut him down and the whole forum too. Man, where they ever mad. It was a post about my dragon on a Warez board in the UK! He must have been the one. I think we still have that data. This guy wants my maps and that site didn't have any I think. I'll have to check. This is all coming together now. Thank you. Damn, now I have to start a folder and everything. LOL

Anton_Kisiel ( ) posted Sun, 15 April 2001 at 3:31 AM

Please, If you know of Warez boards, sites, emails, etc, make a screen capture or send an anonymous email to the artists and stores. I cannot stress enough that Everyone's stuff is being passed around. Finding, reporting and logging these things helps us all. Many times over the past few days I have been so disheartened by this I have wanted to pull all my stuff and do somthing else. But the emails and assistance give me hope that we can stop them. Many people have sent emails and Im's privately sharing support, advice and information. I appreciate all of it. But we need to act, but act together and "sweep the floor". I know alot of people may have used Warez in the past but unless is stops we will start losing artists who are making new models/textures and then there will be nothing to Warez. Thanks Fox, I appreciate your public support.

Been looking around. Helping Anthony Hernandez from Curious Labs locate sites giving away Poser while I'm at it. I'm having hell trying to find these sites giving away poser stuff, though.... they're very well hidden... I mean, how the hell do these people find this stuff?

Poppi ( ) posted Sun, 15 April 2001 at 8:30 AM

they're very well hidden... I mean, how the hell do these people find this stuff? Wow...that is an excellent question. All this warez talk made me go in search of Warez. I typed it into altavista and began following links. What a mess. I found nothing but alot of porn, popping up like mushrooms, randomly on my computer. (Then, my internet explorer crashed and I could not even get to the web for at least a day.) Seems to me, that it would be just as easy to learn modelling ones own self. More fulfilling, too. But, then, maybe you have to know someone with a site....or have an iq of over 180 to utilize it.

DraX ( ) posted Sun, 15 April 2001 at 8:33 AM

Come on now, if these people were all that intelligent, they'd have found ways of making enough money so that they wouldn't HAVE to rip people off, they could buy this stuff for chump change.

Poppi ( ) posted Sun, 15 April 2001 at 8:50 AM

Well, in my opinion, trying to find something in Warez is difficult, to say the least. I don't know how people do it unless they know in advance what to click on.

DraX ( ) posted Sun, 15 April 2001 at 8:53 AM

Actually, I've found it to be quite easy during my searches for people distributing Poser. You find a few sites that have links to actual working sites, bookmark those sites, and then use them to find the others. That's how I found a few sites that I notified Anthony about, anyway.

Marque ( ) posted Sun, 15 April 2001 at 10:07 AM

I know that I will be flamed for saying this, and let me preface it by saying that I don't steal models, although I have been slammed for saying I can't afford it at this time, anyone who has known me from this forum will know that if I want a model bad enough I eventually scrape up the cash from somewhere to get it. I also buy all my music CD's. I'm just curious, and I'm putting on my asbestos suit as I type this, how many of you have CD's of MP3's? And is that considered different than software to those who do? I am not condemning anyone, I am just curious. Marque

Sherlock ( ) posted Sun, 15 April 2001 at 10:11 AM

I heard some folks at work talking about a Warez application that works similar to Napster. One of the guys I work with said he found one of HIS Lightwave models doing a search with this program! I hesitate to post the name of this app, as I hate to promote it to any would-be pirates who might read this. It's sort of a catch 22 to discuss it........and the sad thing is, if one such program exists now, many will follow. Again, I use Napster for comparision. I don't know what we can do to stop them.

DraX ( ) posted Sun, 15 April 2001 at 10:12 AM

I don't see how the topics are related, nor do i see how something like that holds any justification for what is happening to our hard work. I've got a few items I've been planning to finish up and put up for sale, but have become very nervous about doing so as a result of this shite. In my case, I have a hard-drive full of MP3 backups of my entire music collection. Kind of a fail-safe in-case I lose my CDs. It's also a lot easier to play the music I want to ehar when i want to hear it that way. The few MP3s that I don't own the CDs to are live or rare tracks that you cannot find a CD of.

DraX ( ) posted Sun, 15 April 2001 at 10:14 AM

Yeah, I know about that program... I downloaded a copy a while ago out of sheer curiosity. Seems that this app uses the Napster service to transfer zip, ace, rar, exe, etc. files instead of mp3s.... ::cringes::

mocap ( ) posted Sun, 15 April 2001 at 10:24 AM

I have heard here are chat rooms where if you ask the right questions you will be directed to the location where to download PC software. Unfortunatey the majority of warez trading is NOT conducted on traditional "websites" it is done VIA Privately owned Point to Point Servers in the exact fashion that Napter operated.(and still does) you first download and install a small client software much like napsters. you the log on to the static IP of other people running the same software and you gain direct access to THEIR computers to get the warez. (or music) much like when i use "Transmit" to gain direct ftp acces to my directories at Freeyellow.com to upload any animation clips or website files I dont even have to have my web browser running when i am using my FTP software to upload my MPEGS to my free web space at Freeyellow.com I wish Anton And others well in their efforts and im sure law enforcement has indicated they are "investigating" this case but I suspect that the FBI will not commit SERIOUS RESOURCES to hunting down these "desparados "because this is a nonviolent crime. that does NOT involve Huge amounts of unreported taxable income ( warez is given away free) and there is no huge public outcry putting pressure on law enforcment to stop this "scourge" and frankly the majority of the great unwashed masses out there think that "Intellectual property" is a piece of real estate owned by a NASA scientist. ANTON: I am sure your attorney has explained this to you but i think it bears mentioning for the other members of this forum. Once you get these Miscreants into Civil Court you will tasked with providing detailed records of the identity of EVERYONE who Legally purchased your models. and concrete evidence that YOU are the legal creator and owner to the models in question in the first place before you can even begin making your case that some particular ones were obtained illegally. this can be a time consuming and $$$$EXPENSIVE$$$ discovery process. I bought Bryce4 from Compusa for $149 Cash( no ID required) at a closeout sale i never registred it, if I lost my Box manual and originial Install CD ROM, which i still have, Could a Lawyer go to Metacreations/ veiwpoint/corel/ whoever and Prove My seat of bryce4 is legal?? eventuailly but how many $$thousands of dollars in legal fees later? Napster is still up and running because the Plaintive artist have been ordered to provide REAL evidence of ownership/authorship of EVERY SONG of theirs that they say is being traded on napster What a F*cking legal Quagmire!!! unfortunately your Email "evidence" from these people is probably useless because of identity masking email progams Like the popular one called" imposter" make it easy to deny or at least delay your establishing that they are the senders of the emails (MORE Legal$$$$$$$$!!!!) and as far as going after the ISP's of these people you will have another $$$LEGAL$$ battle field to conquer due to the ISP's Privacy Concerns and at best you may get some people's email accounts cancelled. and as far as monetary reward, these people apparently cant Afford $220 to buy Poser4 much less a real modeling App like Lightwave so the prospects of you receiving a monetery settlement from their "estates" seems rather Dim. And with the prison system giving early releases to RAPIST"s and MURDERERS due to overcrowding the prospect of premium prison bed space being given to some hi vertice Illegal dragon mesh trader seems equally Dim in my opinion. This kind of legal Action involving digital material is not like the same as catching the thief who stole you VCR with your name and SS number engraved on the bottom I am NOT advising you in any way regarding you pursuit of this matter Anton you already have a REAL LAWYER to do that. I just thought i would add this perspective to the discussion here at renderosity Mocap

Hey if he contact's thier employer's and buisness contact's and they are legal law abiding citzen's it might make a diffrence in his life. Where he could afford 400.00 before to purchase model's, texture's for his little club's he might be impeded fron doing so at a future date.

Anton, I hope for your greatest success. Such Warez activity hurts all of us, as it discourages the sharing of artwork that makes the Poser community so great. We should each do something, even if a little bit, to help. Our advantage is that we are a large community. We may not be able to eliminate warez entirely, but we can make it harder, less pleasant and less profitable, just by lots of us pursuing the perptrators. - JimX

There's an old saying "A man who will say anything has nothing to say". Geez any old numnuts can say anything, the Internet is great for that. Ok, so what he posts your models. There's nothing to stop him anyway and certainly his word means nothing. Maybe what you have here is some wacko kicking the hornets nest and you people are just going along with it. Probably some highschool kid who saw an opportunity to send a letter to Anton and get him all fired up. Anton! Cool your fricken' jets. I love your work but you are getting borderline wacko. Getting mad and complaining is one thing but you're letting any juvenile with email push your buttons and send you off like a firecracker. "Hey, lets make that Anton guy dance around like a monkey." If this guy was an expert he wouldn't be handing you an email that you could trace. Its just bluff and power trippin'. A real cracker would find your machine's IP address, get through your fire wall, take a snapshot of your machines desktop and email it to you. Just quit letting these people push your buttons.

kbade ( ) posted Sun, 15 April 2001 at 10:58 PM

Just my 2 cents: Locating the warez sites should be the most difficult part of the job. As Anton has retained an attorney, it should be pretty simple to generate a form cease-and-desist letter to the ISPs at issue. Once an ISP knows about warez activity on their servers, it behooves them to boot the offenders, from a legal standpoint. Of course, the bandits can always move to another server. Anton might ask his counsel whether, if the bandits are domestic, as these seem to be, whether it might be appropriate to get an ex parte seizure warrant. It is not unheard of for intellectual property firms to get such a warrant (ex parte meaning without notice to the target), and simply seize the offending machinery. Wouldn't you like to see the faces of some of these folk when you turn up on their door step and take their computer? A warez bandit without a computer is a chastened warez bandit, I'll wager. And I would also bet that word would get around not to F with Anton or his lawyer. As for the Napster issue, that case has not taken a long time because the artists have had to show that they own the copyrights. In fact, that probably took almost none of the time, as I would bet that the songs are all registered in the Copyright Office, and the ownership of all, or almost all, of the recordings themselves is probably documented either in the Copyright Office or in contracts retained by the record labels. Rather, the Napster litigation has been lengthy because: (1) most litigation is lengthy; and (2) the copyright issues in the case are profound. The federal appellate court that recently ruled in the case also held that VCRs violated copyright law. The US Supreme Court disagreed. The US Supreme Court may well take an appeal in the Napster case, though they may not disagree with the lower courts in this case, as Napster is not quite the same as home taping on a VCR.

Dogface ( ) posted Tue, 17 April 2001 at 11:56 AM

If you are going to attempt to navigate warez sites, take a very simple step: Disable javascript. That will stop all the popups and automatic redirects. There are top100, top70, topwhatever web sites that list plenty of warez locales. Most warez these days are stored on "free space" type servers--the ones that give people a "virtual drive", like XDrive, FreeDrive, etc. The problem is that they permit users to have freebie throwaway accounts as the account of reference. The owners know that their sites are warez havens, and they don't give a damn. A great number of warez distribution is done via IRC, where various channels are nothing more than advertisement loops for FTP or IRCserver hosts. You can set up an IRCserver with nothing more than a copy of mIRC and a free script package. How do I know all this stuff? I took a whole hour and poked around online. That semester of library training certainly pays off sometimes.
