Sorry, but there's something a little disingenuous going on here. If you look at the page in question, there's a lot of trademarked material being used -- so much so that if this person were stealing everything, s/he'd be shut down in a second. IMHO, whoever's behind this site is following the rules and wouldnt just rip off some freebie character work when they had to be paying serious bucks for the rights to use Dora, the Marvel characters, and the other licensed materials on that site.
Not making a judgment call, just saying that it's a little curious how this is being presented.

Sharby took them down because someone used his Spiderman for commercial purposes and didn't credit him at all. Sharby understands that he cannot legally sell the comic figures as is because it would be a violation of Marvel TOS, etc. He made them to be making them and not for profit.
The individuals in question used his textures, didn't credit him, AND passed it on as THEIR work to sell some children's products/service. So, now those individuals are under the scrutiny of Sharby AND Marvel.
Thus, Sharby took his stuff down because he got tired of folks using his stuff and not crediting him, plus folks were bandwidth stealing by hotlinking the url's and not making vistors visit his site while he's paying for the bandwidth.
But see, that's the thing: how can he tell for sure that they used his? There are several textures out there for Spider Man, all pretty much exact since, after all, they're all following the same model. The bandwidth issue? Sorry, given the end user in this, that doesnt make a whole lot of sense. What could he have at his site that this place could possibly steal for re-direct?
And I find it a little confounding that the site linked up above seems to have the right to use the Marvel characters, just as it does for the other properties like Dora et al, so the company in question does have the right to use the character for profit. Getting permission from Sharby at this point seems, well, a little disingenuous -- yes, it might be his work, but it's Marvel's property. Any permissions needed would be strictly between Marvel and this site. That may seem a little cold, but that's how it goes: Sharby has no real standing in the relationship.
Further, I'm not sure how anyone can say that this company is "under the scrutiny of Marvel". If they're using Marvel's work without permission, there wouldnt be any scrutiny. They'd be forced to shut down, end of story. Marvel, like Disney, is pretty ruthless when it comes to this stuff -- especially when it comes to flagship properties like Spiderman -- and considering there's also Disney and Hallmark trademarks on that site, this place, in theory, should be gone in a heartbeat. Instead, as I noted earlier, they seem to be following all the rules as far as trademark presentation goes.
And granted, it's hard to tell from the snapshots at the site, but that doesnt look like Poser work at all. It appears to be hand-drawn and -painted... so how does a Poser texture figure into something like this?
Sorry, there really are just a few too many questions here to simply say, "Oh look, they ripped him off!" I'm not saying Sharby is wrong or that the site didnt steal from him -- it's just that, if they did, they used the texture -- or anything else from his site, for that matter -- in such a way that it's pretty damn subtle.

There were separate incidents regarding Sharby. There was the alleged "spiderman texture" usage in one incident and there was bandwidth theft in another.
The texture usage got sharby pretty ticked off when it happend quite a while ago. The website in question used to have larger images of the spiderman and you could see the similarities and "sublteties" that were the same "sublteties" as Sharby's textures. Since then, I'm assuming the website got the authority to license the Spiderman image from Marvel (with obvious modifications) because it now has the "Marvel" logo on their page since it's being used for commercial purposes. The images they used to have didn't look hand-drawn. They had actually looked like they used Poser or another 3D rendering program to intergrate it into their product.
In terms of bandwidth theft, it had been going on for a while before the "texture usage" issue, but I'm sure the texture thing was the straw that broke the camel's back and he took the stuff down as a result.

I totally disagree with you. R D did an great job as Tony Stark, how ever I would have cast some one different to play Pepper Potts and Jim Rhodes. If Marvel ever decided to War Machine in the next movie I did not find T. Howard to be a bit whimpy, maybe Cuba Gooding would have been a better choice or even Vin Diesel.

Amen. I was a little dubious myself, but he pulled it off: looked the part very, very convincingly. If he can keep clean, he might have himself a decent franchise.

Hello all,
After seeing the movie yesterday (awesome btw) my son wants an ironman poster. Sure I could go buy one but i would rather make him one. Does anyone know if there is an IronMan figure for Poser (or anyother software)?
