After reading the thread about trolling in the galleries I had to post this link to one of my freebies. I don't think the responder liked what was offered. Does that type of response discourge me? Not in the least. If the responder didn't like that kit he/she certainly won't like the mega kit I'll be uploading :) More parts and fixes. Anyway, I thought the comment was funny and in a way a compliment that I would be compared to a great merchant whom I won't name here.

Maybe if the readme had been read all would be as clear as the Yangsing River :) For those who have dl'd my other stuff know the only restriction I place is not to re-sell or include in a package that will be sold.

@geep. I probably could have made everything in Poser by following your wonderful tuts but since I'm slowly learning all of the ins and outs of Hex I did it the harder way:) The latest..MegaKit has been uploaded. More goodies to play with. Or cuss me:):) Note, not all of the props are shown.

I'm not much for blocks, other than Lego™ but I did download your house mouse outfits! They're so cute!!

 

EDIT: Although, that mega pack looks like it might come in handy, particularly the table and a few of the blocks. I can see a hunky guy, shirtless,   with a nice hairy chest, in there somewhere ;)

That's why I made it, Arcadia. One never knows when some sort of wall is needed, or even a jail. Sorry, no hairy chest but this is what it looks like, sort of:)

NaySayGuy doesn't care about the hairy chest but he did inquire if there is an instruction manual for this "stuff."  He usually prefers an automatic but he say he'll settle for a manual instead.

With as many people and all the different views on how to construct an item there is no actual manual. Think kids building blocks:) Copy and paste is going to be your friend.

Can I ask a question? AT CGShare when vendors fill in the "Usage Rights" box, what do they mean by this:

Usage Rights: All rights reserved

??

I understand clearly that you do not wish to convey any ownership rights to a downloader. No problem.

But this is a "Usage" rights category. Aren't the choices supposed to be:
personal use only
commercial use ok (or not okay)
unrestricted use but no giving away of the files

or similar?

Please clarify.

I see how the All Rights reserved can be confusing. It was my understanding that it meant I retained all ownership to the items but allowed unrestricted useage as I state in the readme.

My understanding is that the term no longer has a specific legal meaning but in general usage it means that although the author is permitting you to use their property as specified they are not thereby relinquishing their ownership of any rights attached to their ownership. This is/was meaningful as relinquishing of rights by the owner through non-enforcement was/is a legal defense used by those charged with copyright infringement. The classic case is Kleenex which did not adequately enforce the ownership of their trademark for tissue paper while Xerox did enforce the protection of their trademark for photostats. This is why some people/organizations such as Matel enforce copyright in cases of "Fan Art"... they do not want to permit a dilution of their enforcement of copyright/trademark that might be used as a defense in cases of real commercial enfringement. Enforcement is like building a fence... sating "All Rights Reserved" is like posting a sign on the property line so people can not claim that you have abandonded your property rights.

it IS confusing, but not your fault. CGShare should have TWO fields:

Ownership rights:  ALL RIGHTS RESERVED BY CREATOR
Usage permissions: May be used for personal work but not for comercial renders or work

or varients
Usage permissions: Unrestricted use.

etc.

As is, everytime I see "All rights reserved" I never download, because that signals to me "No commercial renders/animations."

I think they should offer the option to check more than one box, so you can check both "all rights reserved" and "unrestricted use"

"All rights reserved" is ALWAYS true of any copyrightable material, unless otherwise explicitly waived.

Yep -- this is the way to handle all of the negative comments that might ever be hurled in your general direction online.  Knowing yourself, laugh about it -- it's got nothing to do with you.  It's got a lot more to do with the internals of the person who threw it.  Or at least that holds true in a case like this one.

I don't know how that troll's comment hasn't been edited out. Not sure about anywhere else, but here in Australia the word tw** means the same as the c- word. So its pretty disgusting.

I sent this letter to CGShare:

I find it hard to believe that this problem has not previously emerged and settled by you.

The way you indicate usage is cause for massive confusion. Why? Because you have the label "Usage Rights". That is a totally confusing term, especially because it is the only field provided.

Many contributors, worried they are giving away their copyright to the item, type in "All Right Reserved." But what does that mean to the user? We are not interested in stealing the ownership of the model. We certainly support the retention of the copyright by the modeler. So really "All Rights Reserved" is perfectly okay and we do not mind that this is stated, and stated boldly, as many times as needed to help prevent stealing, etc.

However, we need to know USAGE PERMISSION. Are we permitted to redistribute the free model to others? Are we permitted to incorporate it into a scene or another model which we then give away? Are we permitted to incorporate it into a 3D model we sell? Are we permitted to make renders using the model, then sell content based on those renders.

In general, we need spelled out for us if and how we can use or distribute the model, for free or for commercial use.

As a film-maker, any download I see on your site that says:

Usage Rights: All Right Reserved

is completely useless to me, since on the one hand I of course respect the ownership of the modeler, but on the other hand it does not convey to me permission to use the model in a set of a film which I might use for commercial purposes. It also does not tell me if I can give away the model for free to others.

You should also have the modeler (assuming they wish to grant commercial usage permission) indicate if they want/need a credit, and the exact language/syntax/name to be used on the credit.

NOTE 1: The ideal policy would be blanket: Yes, yes, the modeler retains all ownership rights to the model; yes, yes the model cannot be given away to others; and yes afirmatively: all models on CGSHare can be used in commercial projects.

NOTE 2: Whatever usage rights policy is established, the ideal would be to have a digital permission file included with the download.

Your site could be a valuable source for companies wanting to obtain models for projects, but with this confusing way of handling permissions, you are missing out.

This topic is being discussed on a thread in Renderosity.com and is of concern to many of your contributors. Please respond to this issue to me, and I will convey the resulting action you intend to take.

In case anyone is following this thread, I will report that I received a timely, welcoming, beneficial email from the  President of  IBSystems, Inc. (ShareCG) with an invitation for a phone call. I called, he answered, we talked.

The result will be a clarification memo coming from him that will both answer my particular question about "unrestricted use" and also give us all guidance on how permissions work on CGShare.

Once I receive hard copy I'll start up a new thread so we can have it as a permanent resource.

It was excellent customer relations on the part of CGShare.

Look for my thread on this forum at a later time.

skip those various warez distributors posing as freestuff hosting sites.  they should
also nail the dckh*d who made the offensive comment.  guys like that think they
can dish it out, but they run screaming to their lawyers when ya slap 'em down.
