Subject: Trying to find an image

I found a thumbnail of the picture attached below online & when questioning about it, was referred that it was found on this site.  I censored the image (even tho its tiny anyhow), the image contains nudity in its natural form.  Is anyone aware of the specific gallery or name of the image or can in some way help me find the original full sized image?  Thanks for the help.

I don't think that would be from here.  To me that looks like bondage and Renderosity doesn't allow that stuff in the gallery here. Maybe they meant "Renderotica"?

It's only very mild bondage, so it would be allowed here from what I can make out.

Was there any other information with the image? What was the name of the actual .jpg?

Unfortunately it was someones forum avatar, so no information.  I had asked em where they got it & they said they found it browsing here.  & cause forum avatars are lumped into a huge storage area, it just had the name "file_412970.jpg" which tells me nothing.  Was hoping someone would recognize it.

It doesn't ring any bells for me. But then there are over a million images in the galleries, so...

If someone is using it as their avatar on another site isn't that theft?...

hello, that is my image, photogmark from renderosity. I have not given anyone permission to use it. Can you direct me to who is using it? thanks. My association, Professional Photographers of America have a legal arm to deal with this type of theft.

It's just a small, non-art based forum.  people take all sorts of anime images & erotic art images just as a little symbol.  I've seen people on these forums, average users tho, using images of things that could be considered property, but noone is making any claims or assertations that they own any of the little avatar pics.  While i dont have a perfect legal definition, I can honestly say trying to stop people from online grabbing little images in that way could open up a can of worms closing down many forums (including this one).  While i am impressed with your work photogmark, i can honestly say noone (well not in this case at least) is trying to steal or take credit for your work.

edit:  just to give an example, does acadia own that image of the cat in the crystal ball, or might someone else have made that image.  Does KarenJ own ForumCat?  Does bobbystahr own that painting of the old man's face?  While some of those answer might be yes, some might be no, thats all the image was used for.  (all examples taken from avatars of users on this thread).

photogmark ( ) posted Thu, 04 September 2008 at 10:32 AM

hmmm, in this case though its a full image that is not theirs. When a person does that they have no idea what terms of the model release they might be violating, the avatar represents a person and their beliefs, or any use of the representation of the image, by extension that image comes to represent those same beliefs or at the very least is associated with it. Those might not be in line with the artist's or the images intended representation. And so on.  While its not really worth the heavy hand of god to correct it, it is worth a gentle request to stop using it.

cheers,
mark

Uh...that's a photo of me and 60 ain't that old unless you're 16 years old...LOL...but that's besides the point. Just because everyone else there does it does not make it right.  A member has objected to the unauthorized use of their professional image and your response is not at all reasonable. Though the intent wasn't to steal, the actual legal fact is that's what was done. A simple "Here's the URL of the site and the name of the member using the photo" would have been more approriate an answer.. ...

Well i dont see any way to PM a user here, so i'll give him the information requested if he will please provide a means of a private response.  I don't believe its proper to publish the info.

Nevermind, found the private sitemail contact.

HI demiseo,
No problem, you can email me the info at
markl@inner-spirit.com
It will be simple request approach, nothing mean or heavy handed. I suspect most of the hobbiests don't really understand the possible impact of what they are doing and do it with fairly harmless intent, this fellow probably falls into that group.

I have been researching Digimark as a proactive path of protection and it seems a pretty inexpensive solution to tracking images on line.

thanks for the concerned heads up on the usage.

cheers,
mark

demiseo...A FYI for future reference, if you look at the top right hand of any page under **Member Links** you will see ***Site Mail***. This opens an internal messenger and click on **Compose Message**, then you simply type the username of the person into the To: field, subject into the Subject: field and obviously the message into the message box. Click send and you're off to the races. You can also access this through clicking either the members avatar or the type at the bottom, 'homepage' and get to their home page where there is also a contact button. See screen grab.. ...
