um, that's not the facts. that's his version of the facts. DAZ banned him from their Artzone because of the proof supporting the accusation that he used one of their textures. that is in addition to the tattoos. and where he refers to the methods of using tattoo photos as for making actual tattoos.... that sounds really sketchy. it used to read that he explicitly was using tattoo flash sites, as he did for real tattoos. not many people seem to remember, but there was actual case law determining that you could copy music and movies and give it to your friends as long as you didn't sell it. that was before digital media was common. napster, for instance, was modeled exactly off of what was legal, and determined to be illegal. downloading someone else's tattoo design and incorporating it into an image of which you're selling duplicates is way different than copying it by hand onto one person's skin.
perhaps he's right, and perhaps there's no violation. personally, i've seen some pretty definitive proof, but i'm no expert and this could be above reproach. perhaps it's only rumors that the artists who made the tattoos issued complaints. but i wouldn't say the "facts" are on the site of someone both DAZ and Renderosity have banned after an investigation. that's a big stretch.

You're right and I appoligise. I did think after I posted that I should have worded it a little differently, I was heading off to work and posted quickly. My comment was basically a knee jerk reaction to stolen tattoos/lawers involved. I am a firm believer in innocent until proven guilty and that there are indeed two sides to every story.
My post was mearly meant to offer the OP the info that the textures were still available and to read the other side of the story and decide for himself whether or not to purchase. I myself don't know more than snippets read in forums and the info on the artists site.

when someone's store is pulled from the Rosity community due to infringements, please refrain from linking to the new store that they put up on their private site to circumvent the ban... it kindof defeats the purpose of banning them.
i understand, and i feel similarly about "innocent until proven guilty." except he was proven guilty on two independent sites. and if you look at the line of textures now, you can tell they're the same base with different tattoos. as someone who is admittedly not a professional, it looks to me like he's taking a DAZ texture, altering its colors (in the same way each time, mind you) and incorporating someone else's tattoo images on them. and doing what seems to be about an hour or two's work over and over and selling tons of copies of basically the same texture with different tattoos.
again, i'm open to him telling the truth about working it out with DAZ and there not being complaints from tattoo artists, but i'm really suspicious that no one else is named, yet now it's supposed to be someone else's infingement, that he continues to use someone else's tattoo photos and someone else's tattoo designs while claiming to be a tattoo artist (artists here in my city can make their own designs, and have their own photos), and that while he offers an email address for tattoo artists to complain, that's utterly meaningless.
if he has had formal complaints and ignored them (iirc, that was how this started), what will an email address do? he doesn't even have to read the messages that come in. and if he does, there's really nothing anyone can force him to do. they can force his hosting service to pull the site, or take him to court. an email address is pretty much a tarbaby tactic. if you email someone who does stuff like this, especially when no one else can see the conversation, you'll generally get into a useless, ennervating flame war and suffer counterattacks. so instead of actually doing anything about the problem, you'll just be wasting your energy fighting with someone who only cares about defending what they're doing.
let me say that's not necessarily what's happening. but i see absolutely no proof that it isn't. and i think it's interesting that this is one of the quietest bans on a popular merchant i've ever seen. i came across this whole thing by accident. DAZ quickly banned him, then upheld stringently their rule about talking about someone who can't defend themselves in the forums. so i've been able to find very little in the way of proof (though what i've found has been quite damning). and now he's still selling those textures on his own, which takes advantage of general ignorance and the word of mouth way info on this has been spread. because he's the only involved primary prominently publishing info.
i feel doubly suspicious that Rendo hasn't taken him back. they're not stupid. they like money. and his characters sell well. if he's worked out the copyright issues and proven that the infringement isn't his fault (which should be as easy as pointing to an URL or resource if he really did get it from someone else), i can't believe Rendo would kill a cash cow.
i'm generally strongly on the side of fair use, and i can list numerous types of derivative works i feel should be protected as collage is. and i don't like random defamation. and i'm keeping my mind open. i would be happy to be wrong. but this really looks like he's trying to make lots of money making minimal alterations to other people's work, using another group's trademarked name and cashing in on the fact that there's a hole in the market. and mind you, the hole exists because it's hard to get professional quality tattoos legally. there are lots of pale, goth make up textures. he's made so much money because of the tattoos, which he openly admits aren't his designs, aren't his photos, and is trying to use as if selling derivative copies of an image published for reference is the same as using it as a reference. sorry, but that stinks to high heaven.
and pointing someone to that as a reference to make up their own mind is a little misleading, because they don't see any of the counter evidence, hear any of the claims, or see any of the problems. i think your heart is in the right place, but honestly, how do you think he'd be "proven" guilty? even if his hosting service were aware of the issues, which seems unlikely, they might not care enough to pursue it diligently if he's paying for a merchant account. and after banning on multiple sites, the only thing left is wiping him off the net and real world legal damages we wouldn't know about anyway. even if they were underway, there'd be no way for us to find out about it.
The official notice from Renderosity stated:
That three “suicidegirlz” items; Mila, Skarr & Suki were removed from the Marketplace for copyright concerns.
These items violated copyrights from Daz3D’s V4 base texture and tattoos from Cherry Creek, Inc, and that the vendor had used other resources without properly listing them in the readme file. Some of the tattoos were from other outside sources in which we were unable to verify if the tattoos were used with permission since they did not respond to our inquiry.
Since there were three items with copyright violations, Renderosity became uncomfortable selling any of this vendors items and removed his store. We suggest that others use extremely caution if they bought directly from him, since he is still selling the items in question.
Since there were valid copyright concerns, all Renderosity orders were refunded and the buyers were told to not use and remove the items from their computers.

Hello all,
I saw a set in the marketplace a few months back of a heavily tattoo'd character for V4. At least 70% of her was covered in goth/punk style tattoos and now for the life of me I can't find her. I'm sad to say I can't remember her name, but I went through about 50 pages of the V4 section and haven't seen her. If my poor description sparks anyone's memory, could you point me in the right direction on where to find her? Thanks very much!!
