Subject: Stolen Art

Hi all,

i'm not really a poser user but i have been reading threads in this forum and looking at the artwork some of you have been doing for some time.

I am here to inform you all that there is a person on a site i'm member of stealing artwork done by poser users and signing them with her name and passing them out on that site.
The site is not a graphic site but one odf the many social sites like myspace and so forth.
I have contacted this person myself and informed her that what she is doing is wrong and unfair on those that put in the time to do these images.

Now i know these images are by you guys because shes even left your name on them, image done by PoserHobbit is her latest one which was done in 2008.
If by chance you guys want any information on this person and the site contact me via site mail.

I have opinions of my own -- strong opinions -- but I don't always agree with them.

couple of other points i forgot to mention. She is using art with Single females in and taking art not just from here put other sites also, one such site is one the artist had setup herself for her images.

This is nothing new, and if they REALLY want to steal my artwork, then they're welcome to it!  After all, all forms of flattery are aprecited!

I am not really troubled by this. It seems that this has upset you, though. I can understand that but I really doubt anything will happen if I were to go there and tell her to stop. Chances are she would say that the work is hers and then what, an argument with some moderator who knows that I probably won't be taking it to court. Four of my adult related pictures here have apparently popped up over at some porn site. I just don't worry about it unless the work in question is something I am making money with, then I call my attorney. Aside from that, why go to the trouble of complaining to people who probably don't care and all over some picture I released to the net for free, in the first place?

However, If this really does bother you, you can contact the site administrator there and prove to them that the works are being ripped off and that you have contacted the original creators about the issue -or- post to the people who have received the stolen works and let them know that she is a thief. I guess there is a chance they might listen. Thanks for the heads up, though. It was nice of you to bring this to our attention.

-ANY- kind of incident of this nature needs to be noticed and mentioned in the areas where the originating artists hang out. There have been quite a few events over the years of art theft that was only found by one person spotting something on another website. If the artist chooses to let it slide that is their choice, but a lot of them don't let it slide. So any warning is welcome.

If copyrighted material is being uploaded to MySpace and posted as original works you can also report that user on MySpace. They will be dealt with.

Really? Hmm have a C& D to send to myspace then. I'd assumed they be as about as helpful as Second Life or Yahoo.

Well I assume they will deal fairly with the original artists. I know that every image of mine that I upload to my MySpace page has a notice that all of the images must not be other people's copyrighted works. See the attached image.

I would like to inform thos interested, i have contacted the site admin as this person is infact in breach of their TOS. Now i wait to here from them.

 Their TOS states...

"upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret,

copyright or other proprietary rights ("Rights") of any party"

...And who gave you that advice in a couple of IM's CrazyDawg? ME! I do care about my art but I have been down this road before. My advice was given because of my own frustration as to how little the Law really cares about "Free Art". Yeh, that's what a lawyer called it. His advice was that if it doesn't have a price tag and/or is not a Picasso the court will not care much. Did I listen? No. And the Judge actually asked me, "what's the harm if you're not being paid for it". And that little thief SOB snickered openly no more than three feet away from where I was standing when the Judge asked me that question. Don't think that doesn't bother me, still. The cold, hard truth was that the Judge was the law and he didn't understand or just plain didn't care.

That person only had to promise that he wouldn't do anything like that again and I still got stuck with the court fee. That little jerk didn't even have to pay the court fee!!! That's the real world at work. So, I learned then that this is the danger of posting art to a gallery on the net. Even the U.S. Government has brought to vote, a bill that would radically reclassify and redefine "Orphaned Art" on the internet. You have more to worry about there then some idiot snatching your works from here. It's a good thing that bill didn't pass. However, it had a lot of support on Capital Hill. If you don't know about this, search the forums here.

CrazyDawg is doing the best that anyone can do in such a situation. He is reporting this theft to the very people that have control over this girls account. That's as much as you can expect in the real world. I don't appreciate the rude tone of the person who responded to both me and DPHoadley. I can't speak for DPHoadley's reasoning because I don't fully agree with his take on this but neither of us were rude to the OP and the comment from SoulTaker was not very nice. I do care about my work but I have a take on this matter based on my own experience, as frustrating as it was and I didn't deserve his comment. I never suggested that CrazyDawg stop posting about this nor ask for his thread to be deleted, that's what HE wanted to do. Apparently, SoulTaker and JenX are under the assumption that I just don't care. Thanks a lot! Next time try asking me to explain before jumping on me.

Living in Israel, with it's daily ups and downs, I'm conscious that there's a lot more important things in life than whether someone has purloined one of my renders of Judy or Posette.

That is definitely true about your situation there in Israel. I wonder how many people in this thread actually did anything about this once they found out, though? I like the reply from William_the_Bloody, though. I too thought that CrazyDawgs request to have the thread removed was a little much. What really ticks me off is that I was IM'ing CrazyDwag about possible solutions to this problem before any of these other people posted to this forum, yet I don't give a dam about my own work. And how does Dale know how many artists let or don't let this sort of thing slide? Does he know them all? Yeh, right.

I can only give advice based on my OWN experiences and nothing more. That is the best that anyone can do, period!  If I have been dealt a crappy hand over this same issue before I am NOT going to tell CrazyDawg something I don't believe. If I did I would be lying to him. But don't let that stop some people. I didn't attack CrazyDawg for his post. I was polite and even thanked him for the warning. I wasn't rude to him, either. I just gave him my take on this COMMONLY OCCURING issue. How dare I do that. So Dale_B, SoulTaker and JenX... should I lie to this guy? Tell him something I don't believe? Is that your idea of an appropriate response?

Oh, and just incase JenX and Dale_b  say they were not rude; if you support a person speaking rudely without first dismissing his rudeness, you support that rudeness as well as his point of view. Definitely not a good thing for a forum moderator to do. You should have advised to keep this thread friendly but you didn't. thanks. That is all I am going to say about this and I am done with this thread.

DPH that  was some crazy close election over there . I was commenting to my coworkers that the Israeli people seem as politically polarized  as we are in the USA these days .

@Doran, thank you for your advice it was most welcome..no i never found anything you told me in the site mails you had sent rude. Infact you had a lot of good advice there which i took in and then used to deal with this issue.

@JenX, thank you for your respounce to this and my mail.

To the others, thank you all for your replies. I'm not a poser user and to be honest it will take me sometime before i can learn the program and turn out images like you have done. Yes i get upset at seeing images stolen and used by people that wouldn't even know what a v3 or v4 was let alone what poser was.
Anyway all its out of my hands now so now i'll leave it at that.

Keep up the great work you do, i enjoy browsing the gallery..

What is even more frustrating is seeing people who DL images from the net that obviously belong to others...especially photographs....toss them into a paint program and frell them a bit, slap their name on them and take credit for having been the creator. Some actually have gone to the extent of posting on the web page the images appear that they are for sale! Go figure.
I saw one such at Renderotica that had obviously grinched David Hamilton photos...I have all his books since way past when so I know whose they were...and did the same thing and collecting kudos and applaus from the others there seeing the work.
I had to say something knowing at the same time noone was gong to bother doing anything about it. See a lot of that over at DeviantArt too.
That is the failure and curse of the internet...where everything belongs to everyone and everyone knows your personal S#!+. Scarry!  :(

Excuse me,

The staff are instructed by our superiors to tell the membership when they report art theft such as this. To contact the artist. Because it is the artist who holds and retains copyright. As such we cannot intervene or do anything on their behalf. Thats not us being mean, thats the law.

So if anyone, thinks that telling a member:

 "If you know of artists here who are having their work taken, feel free to contact them and let them know." is rude.

Then I suggest you take that up with admin@renderosity.com The poser forum is not the place to do so.

Hi again guys and ladies.

Thought i would chip in here and say i have been in contact with the site admin where this person is posting stolen images.
What they told me was the only ones that can object to copyright images being posted on their site is the owner of the picture and i was to get them to contact support and the site.

Now after recieving that email i contacted someone on this site and gave a copy of the members names, email i sent and the reply.
Today i contacted a member to inform her of an image of theirs which is being used by this person. I gave the member this persons name, contact details of the site and also the actual name of the image owned by the artist on here..

That is a little extreme interpretation of what the DMCA act actually says but is fairly common.  Thanks for reporting it here.
