Subject: I've made it bigtime, but don't know how to react

I don't know how to feel about this, but I discovered that one of my renders from back in 2007 posted here, is on a 3D porn page.  The funny thing is that I was looking for reference pics for "babe on a car" type poses.  As this one site popped up, I recognized several pictures from the galleries here and Rotica, but then my jaw dropped when I saw my render there.  I'm surprised that people consider my work good enough for a 3D porn page, but I'm also kinda troubled that they took my render from here, and there is no credit to neither me, nor Renderosity.  Am I alone here, and how should I be feeling?

 If it was something I was working on and lifted from somewhere that isn't public domain I'd be pretty cranky, but in this case I second pjz99.  Congrats on your work being noticed!

I'd be tickled - and smiling as I sent them a DMCA notice and/or a demand for payment.  Not that it would have made a difference I'm sure but I can't see a signature anywhere on the render.

 The only difference there is that you need to make sure that you have the image's scene file archived somewhere you can get your hands on it. Without a signature or watermark somewhere, then they could call you liar and you would have to prove you did the image.

Use a whois to get who is hosting or gives them their domain name and send the dmca to them. So if they don't remove it, their domain will be cancelled or their site closed.

Next time, prior to publishing register your work at SafeCreative or another free copyright registry.

Despite your opinion the law says different.

Since the pic was lifted from here it won't be pornographic.

I would bet you have encountered one of the Adult-Empire sites. They have a lot of sites and work from Renderotica appears regularly. Send them a DMCA notice but dont expect a permanant solution.  I dont know if these pics wind up in the pay section, they mostly are seen on one of the sites preview pages.

If you need help with a whois just pm me the link. There are several threads at rotica about this problem.

I think Apple, that no matter the theme of the image and whether or not we might like it - the creator still has a right to their image ;o). It's been gone thru the courts already in nearly every country...lol.

the TOS prohibits links to porno sites, but doesn't mention porno in re: galleries, excepting
some unacceptable kinds of porno.  they're defensive about allowing soft-core porno here
(nudie pix of young women) with good reason, as gallery views would plummet, should they
ban those.  however, when a porno site steals one's image, just send a letter demanding
payment, followed by a copyright notification.

More correctly, store sales of stuff shown in the gallery and associated banners would plummet, which is the real motivator - not that that's a horrible thing, just it's good to know which end is the tail and which is the dog.

I had the opposite experience once.  I was googling for some 'interesting' pics
and ran into one of my Poser brain anatomy illustrations, reused by
a Chinese stem-cell clinic as part of their publicity.  I probably should have
notified the publisher, but decided it would be pointless with a Chinese destination.

uhhhhm.. in case you didn't know, it doesn't take much for any render of a sexy character to be considered good for a sex themed site.

Most characters are anatomatically correct, .

Don't go against them directly, send the claim to their host provider or domain name provider. Use DTWhois firefox extension to know it. It will get your image removed in a short time, and scare them enough to not repeat it.

Wow, I did not intend to create another pissing match; besides, it's not September yet :)  I just thought it was weird that somebody would take the time to mine Renderosity for pics to be used on a freebie 3D porn page, especially my renders.  From now on, I'll use a watermark, and try that copyrighting site that was mentioned earlier.  If I knew some of the others who were ripped off, I would then pursue the DMCA route as a joint effort.  I'll try to search again for the domain info.

Ok, so it is adult-empire dot com who has snagged a ton of renders from here and Rotica.  Mods, I hope this is ok, as I did not include the actual hyperlink.  If anyone finds their artwork there and wants to file a "class-action" DMCA, let me know.- Starkdog

Well seeing as how Femu Su and the Sixus aliens and images that were supposed to have been grandfathered out of the no nudity rule are now considered to be against the no nudity rule if you don't clothe them, I've had my fill of the whole bullshit nudity argument and removed my galleries here. Problem solved!

Some people seem to think that because something exists on the Internet it's also free and "public domain" which is obviously not the case...

Yep, 'Adult Empire' is ripping off everyone and anyone. They use mainstream scanned comics to promo their sites as well. The share forums is one thing, but this site is outright charging for content they're stealing.

Netherlands huh? I was guessing Russia. I figured it wasn't in the States since they're so blatant they'd surely be shut down by now. Yeah, will probably be tuff to shut adult empire down... without them just switching hosts or whatever. I can only wonder about how folks' charge accounts are being used of those who get fooled into joining them.

I disagree with Apple but believe they have a right to their opinion.

The company that owns it is in NL, but the actual host is in Florida called WZ communications (Do a whois for adult-empire and you'll get their IP: 208.88.226.10 Do a whois on that and you'll see the IP is part of the range owned by WZ)

If you could share links here of adult nature I could give you all 50 links of their promo pages using 3d art from anywhere in Poserworld... consider maddie and such... laws across the board being broken - not just our copyrights. I've seen them use DAZ product promos as promos for their own stuff.

I've told tons of companies.... but they continue.

I've emailed the major comic companies whose whole comics are used as promo as well.

Dunno.

maybe Apple's right in a way - because it's porn, it's not taken seriously or not taken into consideration at all.

I'm not sure why these people should lose their "human rights" when they're doing something that is legal in most countries of the world; I'd much rather see Michael Bay and all the moviemakers who glorify violence and killing in films, and creators of violent videogames, lose their rights than someone who depicts a natural human activity that, when done right, has no losers. ;)

I am sure Apple_UK was speaking hyperbolically or in "humor" since she often claims a sense of humor difficult for many of us to appreciate but since the comment does suggest strong underlying convictions I do wonder how she defines or characterizes pornography... perhaps it was precisely Michael Bay she had in mind.

Which according to Ashcroft v. The Free Speech Coalition (IANAL) are probably legal in the U.S. at least, and probably why they're still there. Paste Miley Cyrus's head on a 3D Mary Whitehouse body though and you're in trouble - as you should be on so many levels.

That's a 2002 case, and has since been made moot by new(er) law:
