Subject: There is a freebie by somebody else that has the same name as my product?

Don't know if this was intentional or not, but what can be done about this? My product is exclsuive to Renderosity and now there is a freebie in the freebie section with the exact same name created by somebody else. Are your product titles not protected when they go live? What are the rules regarding this type of thing?

You could always sue them for trademark or copyright infringement, and get a portion of thier profits.

Or just politely message them and ask them to change the name for your reason.

Lol since its a freebie I doubt there are any profits. I will just ask him/her to change the name.

It "should" be fairly simple to implement a duplicate name check when you upload something - the way sites check to see if your desired user name has been taken already.

IANAL so I don't know if naming something gives you rights to that name, especially for an entirely different product. If you're selling a car named 'Excalibur,' does that mean someone else can't sell a sword by the same name? Whether the store would allow it of course is entirely up to them.

Even products in the marketplace aren't protected from having duplicate names.  I mean, yours are obviously very unique, so it wouldn't be as high of a chance of it happening to you, but just about every time I've ever sold a character I thought I had named uniquely, someone would release one under the same name within a month. :/

I'd contact the freebie maker and ask them to change the name ;)

some of the top vendors are  using the 2 - 3 letter prefix naming conventions.

it's one way to 'brand' your products.

Well the guy was kind enough to change the name. So all is good. Still does not solve the problem of it being released with the same name in the first place. Renderosity should run a product name search to see if new content conflicts with existing ones to avoid situations like this, be it a freebie or a marketplace product.

Using a prefix is a good idea.  Having staff run a name check would be too time consuming and it's bound to happen.

So if there is a product called "Super morphs for V4" there is nothing stopping another person can call his/hers "The Super morphs for V4?"

There is nothing to say that there cannot be two or more products with the same title.

If there is nothing copyrightable with the name then there is nothing to stop anyone using that name.

your best bet to come up with unique name that noone else will use is close your eyes and randomly press several keys. Name it something like "fhajdsgalrdsjfhldsjkfasld for MFD" or call it "Zev0_MDF_texture_21" not very exciting but not too many would actually use it.
