Hi ya! I've heard it said, but could not find it on the SM site, that meshes for Paul and Pauline are free to use for modelers for clothing construction and similar. Which would be commercial use, but not for gaming... It's never been stated that the older characters (Sydney & Simon, etc) fall under the same plan. Perhaps if you ask Smith Micro?

The general rule is that you cannot use a 3D model in a commercial (or even free) 3D game unless you either have a commercial gaming license or the creator/rights owner specifically states that you are allowed to do so.
Let me put it this way, if you use someone else's mesh in your game (commercial or free), it is essentially like using a several-minute long clip of a copyrighted TV show, news video, or movie in your video/movie/documentary, even if it is a non-profit project. You would need a commercial license to use their video (fair use rules are far more lenient towards educational facilities and students)

Trying to figure out which would be cheaper for me, Daz game license which makes me want to hire a lawyer to understand it as it looks like they can sue me for breathing, or the Poser characters, and I can't seem to find the license for their commercial use. Talking about the regular Poser canned characters that come with the program. Also on the lookout for any modelers out there who may be able to help with some things I'm working on but won't have to sell my house, car and kid to buy. Thanks in Advance, Marque
