Subject: Is Buffy:TVS legitimate?

I have developed a Buffy: The Vampire Slayer character for Victoria and was wondering about the legitimacy of offering it up for sale in the Marketplace. Can I do this as long as I don't use the character's actual name? I thought of just calling her "The Slayer" with slightly oblique references to the show.

I reckon you could call her Biffy the Camp Fire Player and we'd still know who you were talking about. First class likeness I must say.... to Biffy that is ;)

Oooohhhh, Excellent! Perhaps, ... the Buff fighter? G Does the similarity hold up when she smiles or snarls? I WANT it! (now if there was a good Willow with realistic smile & worry morphs.... )

Not bad. She has two small divots on the end of her nose (and yes my knowing that is perfectly healthy and normal) and I feel like her cheekies are a little more rounded

oh it is so beautiful, in my gallery I tried using one of sirroco's textures to make SMG in Buffy mode. I love this, really really nice likeness, especially with the eyes and mouth. I'd be keen on buying the texture....really would dig a Faith (although Alex by magnet is shaping up nicely in some of my poser attempts) and Kendra nudge, nudge :)

Wow, that is really much better then any attempts I've ever done...I certainly am impressed! I don't believe, in the long run, that any sort of celebrity likeness can/should be sold without their consent...could get legally messy for all involved. However, I do believe you may have the greatest freestuff morph of all time on your hands. -WTB

Actually, I think that celebrity likenesses CAN be sold... there is some loss of protection when you are a "public figure". I am not sure though :)

You wouldn't be able to refer to them by name, or the name of a licensed character. You'd have to rely on the resemblance itself to sell it.

Cools :) looks great... I'd call her the Hollywood Bimbo Fake Vampire Killer :) That's just me... you want good vampire stuff, check out White Wolf's Vampire: The Masquerade, where REAL Vamps live :)

"Public Figures" are almost always "elected" people & not actors (hum???). Actors & private individuals "own" their "Name & Likeness". Actors earn a living based name & face (& not much else). You can't go wrong with a look-alike under a different name though.

I thought it would be fun and self-serving to drag out my old Buffy morphs and show them here for contrast/comparison. However, due to crash I lost most of my improvements since the posting of "Very Vicky" in freestuff. So, I spent a couple of hours tweaking and re-tweaking for fun and here are the results. I think it would be interesting to have both morphs on one cr2 and see what happens when both are set to .5 Between the two of us, I'd say we'd get her absolutely perfect. -WTB

I would truly love a Buffy character myself, but I hope you will think hard about it. This is not a legally protected parody, which is the only protection you have. Calling it a similar name doesn't make it parody. This is a likeness of the character and actress. If you even suggest that this character is related to BTVS or to the actress (as you already have by posting in this publically accessible forum BTW), you are basically admitting it was your intent to infringe. Sarah does own her own likeness, but even more important is the company behind Buffy. They are likely to be very protective of a character from a TV show that is heavily marketed towards teenage girls. If renders of your character in less than demure poses (ahem) start showing up on the web and they track them back to a figure you are profiting from, they will have no trouble at all stomping you into the ground with their endless lawyers. If you didn't sell it, compliance with a "cease and desist" would probably (maybe) get you out of it. But making money from their character...well, they love to make examples of people to discourage others from doing the same thing (ask any of the many websites that have been shut down for posting art work, or midi files, or take your pick). I would also like to suggest that everyone consider it this way: Would you put Michael or Victoria up on your site for download? Or would you respect Daz's copyright on those characters? Do you think it would would make a difference to Daz if you were selling them or giving them away? And does it make a difference to you that the character is copyrighted to a movie studio or TV show instead of a software company? If you owned Buffy, would you think it was OK? Just wanted to throw that out there to be sure you chew on it again before you go ahead with whatever you want to do ;) Really, I'm not saying don't do it if you want to..you can do whatever you want to do.

scifiguy: If you really want her, as you say, she's in freestuff under BV2. Whether or not the likeness is good enough to hold up in court I suppose is probably open to debate. -WTB

You won't get a debate from me. I wouldn't have needed anyone to tell me who it was for either version! And I think you're right that if you could merge the two it would be pretty much flawless, as is Sarah (sigh). I sometimes tend to rant about these things because of friends who got hammered over fan stuff they did on their web sites. Now I worry about people leaping before they look ;)

Hi, Flawless? I think not.... I've got mates that rave about her, but having watched the show, and seen her interviewed on Leno, etc. I'm of the opinion that both Charisma Carpenter and Alison Hannigan are better looking, (though given the choice I'd go for the red head :) Still, ech to his own I guess.
