pdblake, In lieu of a response from Curious Labs I can at least answer this question (see also my other replies in this thread)... "does Curious Labs own the copyright to those two particular words" No. Words, titles, short phrases, etc. cannot be protected by copyright. Tney can, however be protected as a trademark.

Howdy folks, As was mentioned a ways back I don't see this as a copyright law problem but rather contract law. Since that takes me out of my area of expertise you can take my opinion with a larger than normal grain of NaCl :-) Frankly I don't see the problem. No one looks askance at the multitude of freely redistributable items that contain NON-commercial restrictions in their terms (i.e. "These files are copyrighted and are meant for noncommercial use only. You can give them away if you wish but they can't be sold without permission" ~ from the Ant readme by Bushi). This seems to me, a case of the shoe being on the other foot in the commercial vs non-commercial debate. If you're going to argue that a EULA can't restrict non-commercial uses then, by default, you have to accept that commercial use of a freebie is alse unenforceable. If that's the case, warn me. I'll make sure I'm on vacation for that debate :-) Now as to the "price-fixing" arguement, I'm afraid that doesn't hold water either. There is no pricing standard required, ergo no "fixing" can take place. One more thing that occurred to me while typing the above... For all intents & purposes this is a "mirror image" of an open source license, which allows one to, without permission, modify the base or create & distribute derivatives provided they are NOT offered for sale.

kuroyume0161, I suspect it depends on traffic. There are times when running a trace on a server that turns out to be in New York, I'll be routed via Chicago-St. Louis-Denver-New York (with about 10 mini hops in between :-)

NeoTrace says there is an intermittent server problem (66-100% packet loss)in Chicago that is causing the problem (node 8 of 14 hops between me & them). It's a verio.net server so anyone who is routed through there will either have slow or no access til it gets fixed or rerouted.

That's not going to happen, at least not for the forseeable future. "Tagging" pHp boards has become the new graffiti of the internet with different script kiddie gangs competing for the most scalps.
Originally most of the groups were operating out of S.A., especially Brazil, with home bases set up on smaller irc networks (brasnet.org) or private servers (metronet) because they can use open SOCKS ports on WinGate machines to bounce a connection through a zombie, making it hard to trace.
Best thing to do is stay patched with the latest updates & make sure that you only have one index.html page w/o any sensitive information on it. Fortunately most of these maggots have just enough smarts to create "l33t" nicknames and run a script but have no clue how to do any real damage, even if they manage to get in :-) edited to correct the inevitable typos Message edited on: 04/17/2005 14:45
