Subject: For those who downloaded stasisxxx's 'TECHEYEZ' (yep, you guessed it)

they are a direct ripoff of my [**BlackEyes**](http://market.renderosity.com/softgood.ez?ViewSoftgood=18033) in the marketplace. he has done this several times before, most recently with a light set from shademaster, so i fail to understand why he has not been banned yet -- but that is for another thread.

the product youve downloaded is warez, plain and simple. im not going to demand that you delete them, since i have no control over that.. but i will ask that you keep in mind where they came from and please consider buying the original version in my store. as a 'trial version', unfortunately stasisxxx's ripoff is sadly lacking - theyve been butchered. the few textures included with them are poor derivatives, and the original pack had the eyes propped for all of the millennium characters.

if there is still any doubt in your mind that they are my material, note that they even load as 'Black Eyes R_1' and 'Black Eyes L_1' when you install them. the mesh is identical, and so are all of the morphs. once my customers brought it to my attention (i dont surf the freestuff much), i could spot the ripoff from the thumbnail.

there is another comparison image here, with the 'TECHEYEZ' on the left and the BlackEyes on the right. note that they both load as 'Black Eyes'.

im not handling it well at all.. im just holding it in because apparently calling someone who steals products from you a thief is against the renderosity TOS, whereas actually stealing products like this guy did is fine. in fact, you get the admins rushing to your rescue if you steal someones product and they call you for the thief that you are. i suspect this thread will be swept under the rug soon - either moved to some obscure forum like the copyright forum, or deleted entirely (like the one i posted in the copyright forum was).

Sad. Im sorry u had this happen. Deleted them as soon as I saw this because I do not want a lower quality ripp off.I will buy the original. I have the ones that came with elowen and just love them. So much work went into those, it is a shame this is happaning again. But how will they deal with it since it is a free item? Just out of curiosity.

Yeah the texture ripoffs had me rather steamed as well since they were selling someone elses textures that were orginally free and saying that they were their's. And they are still in the store. :(

I've removed the zombie tex's from freestuff, but BH's eyes seem to have been removed already. I'm sorry this has happened again BH. Kev.

grrrrrr I thought they were a sampler, ugh!!! I'll delete them. Now I have to redo some renders I was working on. Sorry to see this is happening again. I'm beginning to not trust Freestuff anymore. 3rd time I have downloaded and started working with something to find out it's a rippoff of someone elses commercial work. As well as hurting the merchant this activity hurts the individual who downloads them too, this sucks big time.

I think this thread belongs here to people to see what is going on, information for Poser people on Poser forum, the products ar, both Yours and ours for Poser and ar commercial, lisence and readme files do have information what You can do or not to do with the product.

Really? I just don't understand the ethics of this. You know, you can always use internic to look up the IP address of this bulldog site, and send then a cease-and-desist message. THey must comply immediately or you can sue to provider. At least it is something, and will get the content taken down. - Ray

As to the proper procedure, You can provide any sort of cover letter but the information that must be included in a claim of copyright under the DMCA... 1. Name, address, telephone number, and email address of the owner of the information. 2. A physical or electronic signature of the owner of an exclusive right that has been allegedly infringed, or a person authorized to act on behalf of the owner. 3. Identification of the copyrighted work claimed to have been infringed, or, if multiple such works at a single online site are covered by a single notification, a representative list of such works at that site, including any copyright registration (if applicable). 4. Information such as all headers containing time stamps reasonably sufficient to permit location of the material. 5. Please indicate if you are aware of how long the infringing activity is taking place and if you have knowledge that the activity is currently taking place. 6. Please provide your name, address and telephone number.

If this guys been caught doing this before and not banned, make sure Renderosity reimburses you for each copy that was downloaded. After all, they now check every item before it's allowed into the free area so they have a responsibility to you. Especially since Renderosity had to have known this guys track record and should have been extra suspicious of every item he wanted to release.

Ecstacy, The files have already been removed from freestuff here & stasisxxx has been banned. If you want to remove the files from the bulldog.com website you, or someone acting officially on your behalf, will have to file a DMCA compliant statement of copyright with the web host. By law they are then required to remove the files or be liable for damages. I listed the information above that has to be included and the address to send it to... bulldog@bulldog-computers.com

We have taken action. I feel that this is one of the cases that you all should know that we did in fact ban this member. From our TOS "However, there may be certain situations that necessitate otherwise." Thanks for pointing this out to us so we can take action as needed.

gee i stil remind how much copyrights, disclaimers and legal notices i had to write down on one brand of my free stuff (my eyes, talking about it :) I already was so discouraged when i read the threatening "federal warning" (that, left as it is in english in a game sold in my country does not have any value btw :)) from Tecmo's last game ... I even restrained myself to even use any video capture, wallpaper or screen shot as model and simply worked my thing from scratch because of that. It seems that DCMA law only works for those who already have the most money and agressive pitbull crossed lawyers with threatening extrathin suitcases :) I simply shiver in fear for the day someoen will buy a brevet/copyright patent on the word/concept of Eye, of drawing, or any basic action (it MAY be possible i am sure :). Every people having Eyes in theri skull should pay royalty then :) it is all insane

A word of support for BH: I recently purchased Black Eyes v2.0 and must say that they are excellent value for money: high resolution eye props but with low overhead for photorealistic renders; works with ALL the Millenium family and costs below 10 bucks. Wonderful! Buy the original, people!

there is no such thing as copyright on an idea anyone can model an eye. However, you can copyright your model of an eye. You know, there are several eye models for sale in the poser world, some are even legitimately for free, all of them are different models. it is simply not possible for you to create the exact same model as someone else. I have created my own eye prop and its also very different from all the other eye props for sale. There's really no reason to steal someone elses props, and give them away for free, when you can get decent eye models for cheap, and for free, or even make them yourself easily. what stasisxxx did was despicable, and I'm glad he's finally banned.

Jeez - this stasisxxx seems to have a pathology. They don't seem to be able to help themselves from piracy. Farside had a good point in that the freestuff is monitored now by Renderosity before going up - so how did this pass? Especially with the history/track record of the uploader (stasisxxx)? I would think that anything coming in from them would've been scrutinized thoroughly and suspiciously. I'm glad it got somewhat resolved. I feel for you Ecstasy and Blackhearted. In fact, while I have (and love) AwfulEyes, I've always had an eye (no pun intended - well maybe a little) on your set and now I think I'll get em. Not only for support but to encourage you to continue making any manner of product(s). : ) Take care.

you can do one of two things I think to stop getting ebots: 1) uncheck the box next to "Email me when someone replies" 2) stop visiting the thread. If you stop visiting then I think you may get one or two more then they will stop. Hope that helps Keep rockin' /gz

Hi, thanks kbennett. Yes, I understand that but the real point in my comment was that if stasisxxx has done this before then the fact that they submitted should be what was watched for. Like when stores have people flagged for bad checks; they keep a list - then the checking is only a matter of saying "Hmm, stasisxxx" you see that the item is "eyes" and then the search for products only has to be done for eyes - not every item in the store. Maybe it's a lot to do but I know there a few pirates (or have been) here and it seems that since you know (or can know) their names, an extra layer of check should be relatively easy. Certainly easier than the havoc that happens when these situations happen. I'm not meaning to argue or rebel rouse - that was just the notion I had.
