I want use a screenshot out of a game as a background for a poser work, but now theres the question if these is a violation of copyright... Any suggestions...? Andreas

Depends what you are using it for. The copyright laws do allow for "free usage" for personal use. That is why you are able to photocopy pages from books at the libary. If you wanted to publish the work, there might be a problem. Not sure if "fair usage" covers it.

Write the game company, tell them what you wish to use it for and ask their permission. 1.) They will, most likely, give you permission as long as your use is not in some way defamatory to their product and 2.) They will shocked that someone in today's "Napster-culture" actually respected their copyright and asked.

Well, today it seems such questions do not have decisive answers until the individual case is tried in court. I suggest that as a general rule if you even suspect it may be an infringement then you behave as if it would be.
