I don't mind if someone wants to use a photo of mine...a design I have made in my line of work,  or even if they want to reproduce something I have built.....to me that is a compliment.
The only time someone should  be brought to justice is  when they take something ... manipulate it and use it out of context.
In this way it is a false representation, and  not how originally intended.

Thanks....and to keep in mind as I understand it, without a release a "model" holds the rights to the image.  Is a shot in a public place using a "model"? Hummm...I believe that gets back to the personal privacy part of the info posted. Thanks again, Valou.             Tom.

Really?It's so confusing!I say that because my daughter modeled for a group of amateur photogs,one of which is now using her image for various enterprises...and we were told because she 'didn't  sign' anything,the images were his to do with as he pleased. :^/

@Margana....I think your daughter has a definite case here.  They do require a model release in cases where the person is identifiable in the image.  So, exactly the opposite of what you were told holds true....they can't sell the image if she didn't sign.  Most reputable organizations that purchase photos ensure that a model release is IN place....because they don't want to get into trouble when they use the photo for advert purposes!!!

Case in point just last year if I recall....the photo of the guy in the Folger's coffee ads...the photo was taken many years ago...turned out there was no agreement to use his image...he ended up with a huge settlement.

My pretty margana, your daughter need to frm, i do that with all my model. you needn't to use a paper very special, but only a text with your name or of your daughter and writing what is ...

Well,it kind of bothered us,that he was making money off of his picture of her,and she got nothing for it.It didn't seem right or fair to us.After all,she wasn't paid to model for that group in the first place.

Oh well.At least we now know what to do should she ever be asked to model again.

Notes:

• The part green color must in makes specify the use of the images in the most detailed possible way: edition, exposure, sale etc In the event of sale it can specify the percentage perceived by the model.
• For the duration, the fact of authorizing “with life” for example does not have a legal value, it must specify one given duration.
• This is a standard authorization “minimum”: any detailed information can be added in condition of course in perfect legality. The principle in fact is to prove that the model gave well its authorization for a type of use, knowing however that the model is sole owner of its image. For the minor models the authorization will be given and signed by the legal representative.

I don't know the distinct law on the world for this job, but in spain or french, all models no have the same law. I explain you, if you need to capture a people under 18 years old, you must have a representation of the parents or family during the scene of photo. This younger no cannot to work more 2 hours...

Well, you need to see these laws for your coutry

I like to made a contrat for all the thing. Example: 1/ when i capture the cats (in my gallery) i have to firm a contrat with the association of animal protection (where  live these animals) and me... 2/ all my model firm too a contrat.... it's the best for your protection and the protection for the model...
