Subject: Website TOS, copyright questions

I'm not sure if this is the right place to ask, but I couldn't find anywhere else that looked appropriate.

I am building a community website to serve as a database of all the Poser content available from all the major online stores. The plan is to have a 1 stop location where artists can search for content and share metadata for that content.  All the listings on the site would link back to the original store for purchase.

I have a few questions regarding this:

  1. Is there an official API for accessing the Marketplace website content?

  2. are there any restrictions on using the content (product descriptions, related products, required products, images, etc.) elsewhere, either commercially or freely?

  3. any other restrictions I should be aware of regarding site scraping, web crawlers, or other TOS issues?

The site itself would be free, and hopefully able to support itself through advertising and affiliate links for content purchased through the site. I do have some ideas for some future products that may utilize the data available on the site, but those are completely separate from the site idea itself and won't impact the business model of the community site.

I want to cooperate fully with Renderosity on this effort, and make sure I am not violating any TOS for the website or copyrights on the data. I think this effort would greatly benefit the community and Renderosity, and welcome any comments or suggestions you have.

  1. No, there is no api for our Marketplace. 

  2. The vendors own the copyrights to images and products, so typically they shouldn't be used. However,  we make an exception for Renderosity affiliates who link to the product pages for sales, and have no other questionable or illegal activities on their site. (like file sharing). 

  3. Site scaping and web crawlers depend on exactly what you are doing. Anything can cause a "disruption of normal site operations" could be TOS violation, so just be careful that anything you do doesn't create a load on the system or cause problems (like a dos).
