this doods doin a game with some poser models and props that are released only non comercial.. including my headset..the jin roh armor (dunno who have done them,but im sure it was noncomercial) and other stuff... sure ,it looks cool :p but why there are nowhere credits who the models have done?

Did you contact the game operators to ask about credit or if they intended to ask for permission to use the items in their work? Do so quickly :)

If you know that the props belong to you, then request that they supply the uvs to prove they did their own work. I am suprised that they have license to use poser figures/props for their game in the first place. Didn't know anyone could do that...

ive not alone worked on this model... TBkoen wasalso involved...and many peoples have downloadet my prop from freestuff... its relative popular in SF pictures in the gallery

The lower half of the male face texture reminds me very vaguely of one I did about two or three years ago that I called Rowan. It might not be. At that resolution, and the angle, and the head gear, it's really hard to tell. I don't want to claim it's mine without proof, but it does remind me of it. Melanie

...it looks as if their artwork is Poser stuff, but unless they use any of the "concept art" on the box or any of the meshes in the game itself, there's not much you can do at the moment, legally. Judging by the screenies, there's no Poser models used (and quite frankly, I'd kiss their backsides if they made an engine that could render that many polys at any one time...) /P

Unless the products were specifically stated to be not for commercial use, they should be able to use them in their artwork. That would only be distrution of pictures they made. It wouldn't be redistrution of textures and mesh.

They appear to be using Poser only for the illustration purposes, not for ingame geometry. Take a look at their game screenshots, only fighter jets.

Yes, but whether they are using them in the game is not the question... they are claiming the copyright. THAT is the issue. If the people who made the items don't fight it now, they will lose the copyright. Sometimes art is borrowed for inhouse demos to show proof of concept (mostly, do the mechanics work), and artists aren't hired until the game is spec'd and ready for production... however, art put out publicly by a company needs to be original or have licenses and permissions. I would suggest just contacting the managers privately and asking about the situation. Perhaps they are not using the free items for any commercial use at all and are only claiming copyright to the image itself. In any case, it would be best to ask the managers it may all just be a misunderstanding. Best to figure it out privately and promptly.

While this is true of trademarks it doesn't apply to copyright. I kludged together a couple of answers from the copyright forum where this has come up before...

Copyright cannot be lost through neglect (see #5 at the link above). It can only be lost through expiration,(currently 75 years after the creators death) or all rights can be given up by placing the item into the public domain (this must be done specifically by the person who originally held the copyright).

The hair in the first one is the Reika hair by Minerva as well.
