So daz only use selective copyright laws?

Marque ( ) posted Sat, 19 March 2005 at 6:56 AM

Wonder why they didn't advertise it? Hate to buy it again for just a few new things. I don't think their copyright laws apply to this, I believe they did it in-house didn't they? Marque

Marque ( ) posted Sat, 19 March 2005 at 6:59 AM

Yup just checked, says it's a Daz original. Would be cool to have a female gremlin though...lol Marque

xantor ( ) posted Sat, 19 March 2005 at 7:17 AM

It`s not where they did it, it is a gremlin from the film.

geoegress ( ) posted Sat, 19 March 2005 at 8:35 AM

goose and ganders must live by different rules. this thread, BY renderosity rules should be moved to the copyright infringement forum! LOL- it's even against the rules to POST a pic of it on this site.

Gareee ( ) posted Sat, 19 March 2005 at 9:14 AM

Actually, his appearance can vary depending on what morphs are applied. His default settings are his mean old self. I did the morph additions for him, and added some body part scaling as well.

Way too many people take way too many things way too seriously.

uncoeur ( ) posted Sat, 19 March 2005 at 10:38 AM

funny... I dont see how this looks anything like the gremlins from the movie...
besides... werent the monchichis a copyright infringement of the mogwai from "Gremlins"?
(oops I think I just dated myself)

anyway... unfortunately (and I know this from the music/production industry) a copyright infringement can only be claimed if the product matches a certain amount of features.

It can still be a little bit different and not be a copyright infringement. That's why people can steal beats COUGHVANILLAICECOUGH and still come out smelling like a rose.

It's a fine line, but if you walk it close enough... there is no copyright infringement.

The gremline model - remember was a physical puppet... noone has made it a virtual puppet before. maybe this is where DAZ can do what they did with it.

Gremlin is also not termed as "a star of a movie made by blah bla blah."
it is an actual word:
(from dictionary.com)

  1. An imaginary gnomelike creature to whom mechanical problems, especially in aircraft, are attributed.
  2. A maker of mischief

This could be why they can use the name - because it is an actual word... you can't trademark a word.

Hope this helps a little ^_^.

xantor ( ) posted Sat, 19 March 2005 at 11:05 AM

I know the word isnt copyrighted, I suppose it does look different enough, but if someone made a character similar to a daz figure they wouldnt be happy with it.

Gareee ( ) posted Sat, 19 March 2005 at 11:29 AM

Well, Xantor, then you could also say the Power Pixie looks like a gremlin as well, since many of the same type of morphs are in that character as well.

"besides... werent the monchichis a copyright infringement of the mogwai from "Gremlins"? (oops I think I just dated myself)" Not just did you date yourself, The Monchichis were around long before Mogwai

uncoeur ( ) posted Sat, 19 March 2005 at 10:36 PM ยท edited Sat, 19 March 2005 at 10:37 PM

hehe... wow... I need a brain overhaul...
then I suppose the mogwais were a copyright infringement... lol not that the creators of the monchichi's could have fought that battle...

i could have something copyrighted and microsoft has enough power to override that... unfortunately... if you have a good enough lawyer - anythings possible... look at OJ Simpson.
