should images like this be allowed to be shown through ads in a community that takes down non offensive and much less provacitive images. if you think this looks like the mouth of an adult then fair enough. but if you don't and you're a mod why is it allowed

looks like tera yukie(whatever her name is!!) to me!! i think if clothed you could do a suggestive pose like that with her! but also think that it has been made clear, that things are sold in the marketplace, that you may not use in the galleries here!! so it might be one of those things.

though it does say this in the tos...No depictions of young humanoid characters/children giving the appearance of being under the age of 18 displayed in erotic, seductive, provocative poses or context. does the image floow the tos guidline...which i thought covered the whole of the site

as an added thought ..if you can't do a sugestive pose with her naked then according to the tos you can't do one with her clothed either.  not allowing the first means shes deemed under 18 and as such no suggestive pose can be allowed. on that basis isn't the ad breaking the tos.

I would say it wasn't beaking the TOS Billy simply and purely because all you see is the mouth.  Whilst said mouth could, theoretically, belong to a humanoid character that appears to have a real life age of less than 18, if she were indeed a person and not a digital creation.  Said mouth could also, theoretically, belong to a character that is in their early 30's.  Without seeing the entire face you cannot be sure what age is being depicted and I always assumed that this banner showed a young person in their early to mid-20s rather than being a lolita character.

Also poses that may look suggestive on a naked figure often look completely different on a clothed character.

i would think if the ad appeared to you as you were viewing the galleries section, then it could be deemed a breach of TOS, but if the add appeared while you were in the marketplace or forums, it may not be a breach, not sure how the banners are moderated though, i don't actually notice them very often(LOL)

with a clothed tera yukie, with hands on hips, kinda leaning in towards viewer, with that face pose, i don't think it would be that provocative anyway(there was no mention of her recently with the aiko thing,but she is anime!) i think she would be like the lipstick adverts you see, where the model isn't definetly saying "kiss me" but just saying "my lips look good for kissing" (whatever the diffence is there!!)

but if you had her on her knees, with two naked guys standing in front of her(viewer sees them from behind, and her from front) with that face pose, then that would be provocative, and probally a breach of TOS!!, just guessing though as i don't actually know, and not sure if anyone would know, use it and the image could get pulled or not, who knows, not me, do you know? who said that? "eek!!" who said "who said that?"....hello!!....................................oh!

And it could belong to a 5000 year old fae or simply a sphere with a hole in it. But it LOOKS like a humanoid character under the age of 18. And it certainly looks provocative and therefore in breach of TOS. Bookmark.

Every time I see that banner I want to whip an ice cream cone out have a blob of ice cream on her top lip that she's licking off.

As it stands, it's just a picture of an open mouth and nothing more. To say it's provaocative regardless of what the text says is just daft.

Yes I do know what you're implying with the image and text but really it wouldn't be a TOS even here IMHO.

Now if she were licking "Ice cream" from her lip then that would be different because we all have minds set firmly in the gutter don't we!!

Yes, a I think reasonable person sans a preordained agenda (if you can find one) could see it as a "child." The seductive part is perhaps more subjective. For all I know, that (partial) expression might be considered something entirely different in some cultures but I don't think seeing seductive there is unreasonable. Is it against the TOS? Who the hell knows anymore. File a complaint and maybe they'll pull it, perhaps depending on how much revenue the merchant brings in, or who the mods are or what the goat entrails tell them. How about a just little hand with Care Bear nail polish beckoning? Even with negative nudity held constant, you still have two independent variables, age and seductive/suggestive.  Do a quick calculation and you'll see that we're soon down the rabbit hole with Alice. But we all know that Lewis Caroll had a thing for little girls :-)

The marketplace and the galleries are run separately.  For information on marketplace ads, you'd have to speak to the marketplace staff.

i think the ad was in the gallery section though don't hold me to it cos i can't remember. just asking in general if the tos applies to the whole site or just the galleries?

i take it those that place ads are classed as part of the site

Regardless of where they are shown, Site Staff has no control over the banner ads.  To get any info on them, you need to speak to MarketPlace Staff.

i understand its not down you the mods here morrigan. i was trying to see what thoughts were as to if people and that includes mods  thinks it breaks the tos.

some people here will get banned for 3 days if they put an image up that the mods dont like, others will get to change the image without being banned, others still will not get thier work taken down even after its been reported. its not whats in your work its who you know and has always been that way.

if your going to have rules then have them for everyone

I think images like that should be allowed. but it's an over-done cleeshay, and it can even be annoying, as when a politician or some criminal suspect is constantly licking its lips during an interview on cnn or whatever. it can also be a valuable lesson in what not to do, as they'd get more hits with a more creative, original banner IMVHO.

i think images like that should be allowed as well but according to the tos they shouldnt. i can't see any thing wrong with the image per say but that and many like it break the tos....just think the admin should follow the rules and i  no the mods in here have no control as such but other admins do. if the tos is for everyone  then make it so as luc picard likes to say. i've actually been told by acadia that theres two sets of tos regarding chil image violations. how many others think theres two sets of tos. i asked the admin in the community forum as morrigan suggested cos she has a good point about here having no control as such. no answer as of yet
