Hmpf. Can one actually take someone to court to prove there is no violation? The burden of proof in these cases is on the person claiming there is a copyright violation.

All I can say is, Manitou or the werewolf was not really a 3dart.
It was hell lot of sweats and sleepless nights for me.

So what is Renderosity saying?  Do they not also have to make a determination in their minds if it is a violation or not? 

Why is this not back in the store if it is not a violation?  This is what I'm not understanding.  They generally compare the meshes/textures etc. themselves and make a determination and either put the product back in the marketplace or inform the merchant that it is a violation as well as anyone that had purchased it.

It should not be up to Sanctum Art if your product is for sale at  Rendo if there is no violation. 

This is really ridiculous and is beginning to look like once again SA is using it's bullying tactics to control the MP whether it be here or anywhere else in Poserland.

They did not invent the werewolf....only their mesh of it. 

nothing to do with the fact that the two figure models are werewolf's, nothing at all.  It has to be more than that like mesh used, UV's, texture, poses something in the Horde Product used in the Manitou product intentionally or unintentionally.

Renderosity doesn't publicly make statements on copyright cases acording to their web page, they pull the product in question and leave it to the parties involved in the claim to work out as they are the copyright holders and only they can defend their claims.

I had this product on my wishlist as I honestly thought it was an addon pack for SanctumArt's Horde product.  Something in this product made Micheal Rak (SanctumArt) make a claim and Micheal has been doing this for a long time and not just for Poser.

I don't think anybody should be dragging people's names through the mud about this.  It's between the two parties and the terms of the claim, not for to the public to decide.  Hopefully the Manitou product can be changed if needed to satisfy the claim of infringement and then both parties can move on.

Obviously you have not been on the receiving end of some of SA's tactics, MachineClaw.  I'm not dragging anyone's name through the mud, I am just stating what I have seen friends experience and other observations of their posts on various sites. I am also very well aware of what  SA does.  

And as one having to have compared mesh's/UV's texture etc I know what it entails....and I also know that it normally does not take this long.

From what I have seen in the past (maybe their policy has changed) Rendo does in fact do their own comparisons and keep track of what goes on between the parties.  They have a vested interest in this also, and I do not remember them ever taking a total hands off approach on these matters.  

This just seems to be taking a long time for resolution and now he's talking about having to take them to court to get it resolved. That doesn't sound right.  Either there is a mesh problem or there is not. 

In any case, I am not here to argue with you or anyone else.  I'm not going to get into a he said/she said type of situation. But I am entitled to my own opinion about a broker and I have a very strong opinion about SA, simply because I have seen what they have put some of their customers through.  If you think that is dragging people's names through the mud, then you too,  are entitled to your own opinion.

I hope like you that the outcome is a good one for the Manitou and for Mestophales and that he has not infringed as SA has accused him of doing... that would be very sad.

this is the very first time i've seen an active thread about a violation at Rendo and no statement whatsoever about the findings.  when ByteMeOk issues were going on, i read about it.  when people posted about Suicidegirlz (or however he spelled it to try and avoid trademark infringement), someone from staff posted about what they had found.  and some posting was going on elsewhere, because merchants had lots of details i never could find.   i've yet to hear one peep out of anyone other than the accused merchant. 

it's true that we shouldn't jump to conclusions.  but SA is a boy who cries wolf.  a lot.  and he's not only been disdainful of others' work, he sold this particular model by saying how unique and superior it is and making insulting comments about the other werewolf released before it in his marketing.  he does incredible work, but honestly, it's only unique in Poser circles, not professional CG ones.  and outside of GRIM, Horde is probably his most typically styled work.  it looks straight out of movies and games.  that's not to say it isn't great, but it's far from unlikely that someone else from the pro CG, Zbrush user community would create a similar creature for Halloween.  it's actually been a testament to reluctance to try a different business model (selling IP rather than selling your craftmanship) and cultural barriers in the pro community that more serious pros haven't decided to make money off us like Stonemason and SanctumArt. 

if this isn't an infringement, i won't be surprised.  i'm definitely wary, but my wariness cuts both ways.

Has there been a status update on this?  I noticed that Xurge has released his armor for the model--very nicely done!
